June 27, 2017 <br /> <br /> i. Conceptual Site Layout Plan of Wendy’s Restaurant prepared by MSA, P.C. <br />dated March 17, 2014 as modified to comply with the recommendations of the Traffic <br />Impact Analysis prepared by Bryant B. Goodloe, P.C., dated March 11, 2017. The <br />specific design of the right turn only exit and other improvements in and to the public right- <br />of-way shall be approved by the City Engineer. <br /> ii. The rendered elevations prepared by Ionic Dezign Studios dated August 30, <br />2016; and <br /> iii. The sign elevation prepared by I.D. Associated dated March 2, 2017. <br /> <br />(b) A plat consolidating the individual lots into a single parcel shall be submitted to the <br />City for approval and recorded prior to final approval of a Site Plan. <br /> <br />(c) The applicant must obtain and keep current any required operating licenses, <br />approvals and permits and shall operate in accordance with all federal, state and local <br />regulations. <br /> <br />(d) All taxes/fees associated with the property and/or the proposed use shall be paid <br />when due. <br /> <br />4. Solely in conjunction with the construction and operation of the use <br />authorized by this Resolution on the property, the following modifications to certain <br />standards of the Uptown D2-Form Based Code District are hereby authorized and <br />approved: <br /> <br />(a) D2-FBC Requirement: First floor must be greater than 15 feet tall and less than 22 <br />feet tall. <br /> Modification Authorized: The first floor of the restaurant building shall be not less <br />than 10 feet tall. <br /> <br />(b) D2-FBC Requirement: The building façade must be at least 75% of the length of <br />all three (3) street frontages. <br /> Modification Authorized: The building façade length requirement shall not apply to <br />the frontage along Chestnut Street. <br /> <br />(c) D2-FBC Requirement: No blank walls longer than 20 feet are allowed along the <br />building frontage. <br /> Modification Authorized: Blank walls longer than 20 feet shall be permitted along <br />the Queen Street frontage and the Chestnut Street frontage of the restaurant building. <br /> <br />(d) D2-FBC Requirement: Rear wall must have at least 20% clear space. <br /> Modification Authorized: This requirement shall not apply to the rear wall of the <br />restaurant building. <br /> <br />(e) D2-FBC Requirement: Eaves between 18 inches and 30 inches must be installed <br />all around the building. <br /> Modification Authorized: Eaves meeting this height requirement are not required <br />to be installed all around the building. Eaves meeting this height requirement shall be <br />installed along not less than 30% of the building. <br /> <br />(f) D2-FBC Requirement: Curb cuts must be located at least 75 feet from each other <br />and from block corners. <br /> Modification Authorized: This requirement shall not apply. Curb cuts shall be <br />installed in accordance with Section 3(a) hereof. <br /> <br />(g) D2-FBC Requirement: The building façade must be built to the required building <br />line. <br /> Modification Authorized: This requirement shall not apply. The building shall be <br />oriented on the property in accordance with Section 3(a) hereof. <br /> <br />(h) D2-FBC Requirement: A 30-foot parking setback is required from London <br />Boulevard, Chestnut Street, and Queen Street. <br /> <br /> <br /> <br /> <br /> <br />
