June 27, 2017 NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That it finds that the use for which the permit is sought: (a) Complies with the applicable standards of the Zoning Ordinance; (b) Is consistent with the comprehensive plan; (c) Is compatible with the character of surrounding lands and the uses permitted in the zoning district(s) of surrounding lands; (d) Is configured to minimize adverse effects, including the visual impacts of the proposed use on adjacent lands; (e) Avoids significant deterioration of water and air resources, and other natural resources; (f) Maintains safe and adequate egress and ingress onto the site, and safe road conditions around the site; (g) Allows for the protection of property values and the ability of neighboring lands to develop the uses permitted in the zoning districts; and (h) Complies with all other city, state, and federal laws and regulations. 2. That Wendy’s Properties, LLC is hereby granted a use permit pursuant to Section 40.1-2.3(B) of the Code of the City of Portsmouth, Virginia (2006) to construct a restaurant with a drive-through window at property consisting of 833-835 London Boulevard, 433-445 Chestnut Street, and 818-828 Queen Street, Portsmouth, Virginia, being more particularly described as: UP-17-01 833-835 London Boulevard, 433-445 Chestnut Street, and 818-828 Queen Street (Tax Parcels 0024-0810, 0820, 0830, 0840, 0860, 0870, 1060, 1070, 1080, 1090, and 1100) COMMENCING at the southeast intersection of Chestnut Street and London Boulevard; thence southerly along the eastern line of Chestnut Street 226 feet, more or less, to the northeast intersection of Chestnut Street and Queen Street; thence easterly along the northern line of Queen Street 140 feet, more or less, to the southwest corner of property now or formerly owned by Archland Property I LLC, said property having a current address of 816 Queen Street and a Tax Parcel Number of 0024-1050; thence northerly along the western line of said property 113 feet, more or less, to the northwest corner of said property; thence westerly 25 feet, more or less, along the southern line of property now or formerly owned by McDonalds Corp., said property having a current address of 801 London Boulevard and a Tax Parcel Number of 0024-0900 to the southwestern corner of said property; thence northerly along the western line of said property 113 feet, more or less, to the southern line of London Boulevard; thence westerly along the southern line of London Boulevard 117 feet, more or less, to the southeast intersection of Chestnut Street and London Boulevard, the point of beginning. 3. That the use permit is approved subject to the following conditions which shall be observed by the applicant and any successor in interest: (a) The proposed development shall be in substantial compliance with the following documents submitted by the applicant, except where modifications may be required to comply with the City’s Ordinance requirements:
