June 27, 2017 <br /> <br />NOW, THEREFORE, BE IT RESOLVED <br /> by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That it finds that the use for which the permit is sought: <br /> <br />(a) Complies with the applicable standards of the Zoning Ordinance; <br /> <br />(b) Is consistent with the comprehensive plan; <br /> <br />(c) Is compatible with the character of surrounding lands and the uses permitted in the <br />zoning district(s) of surrounding lands; <br /> <br />(d) Is configured to minimize adverse effects, including the visual impacts of the <br />proposed use on adjacent lands; <br /> <br />(e) Avoids significant deterioration of water and air resources, and other natural <br />resources; <br /> <br />(f) Maintains safe and adequate egress and ingress onto the site, and safe road <br />conditions around the site; <br /> <br />(g) Allows for the protection of property values and the ability of neighboring lands to <br />develop the uses permitted in the zoning districts; and <br /> <br />(h) Complies with all other city, state, and federal laws and regulations. <br /> <br /> 2. That Wendy’s Properties, LLC is hereby granted a use permit pursuant to <br />Section 40.1-2.3(B) of the Code of the City of Portsmouth, Virginia (2006) to construct a <br />restaurant with a drive-through window at property consisting of 833-835 London <br />Boulevard, 433-445 Chestnut Street, and 818-828 Queen Street, Portsmouth, Virginia, <br />being more particularly described as: <br /> <br />UP-17-01 <br /> <br />833-835 London Boulevard, 433-445 Chestnut Street, <br />and 818-828 Queen Street <br />(Tax Parcels 0024-0810, 0820, 0830, 0840, 0860, 0870, <br />1060, 1070, 1080, 1090, and 1100) <br /> <br />COMMENCING at the southeast intersection of Chestnut Street and London Boulevard; <br />thence southerly along the eastern line of Chestnut Street 226 feet, more or less, to the <br />northeast intersection of Chestnut Street and Queen Street; thence easterly along the <br />northern line of Queen Street 140 feet, more or less, to the southwest corner of property <br />now or formerly owned by Archland Property I LLC, said property having a current <br />address of 816 Queen Street and a Tax Parcel Number of 0024-1050; thence northerly <br />along the western line of said property 113 feet, more or less, to the northwest corner of <br />said property; thence westerly 25 feet, more or less, along the southern line of property <br />now or formerly owned by McDonalds Corp., said property having a current address of <br />801 London Boulevard and a Tax Parcel Number of 0024-0900 to the southwestern <br />corner of said property; thence northerly along the western line of said property 113 feet, <br />more or less, to the southern line of London Boulevard; thence westerly along the <br />southern line of London Boulevard 117 feet, more or less, to the southeast intersection of <br />Chestnut Street and London Boulevard, the point of beginning. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) The proposed development shall be in substantial compliance with the following <br />documents submitted by the applicant, except where modifications may be required to <br />comply with the City’s Ordinance requirements: <br /> <br /> <br /> <br /> <br /> <br /> <br />
