136 <br /> <br />December 9~ 1986 <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth,:V~rginia, that the Virginia Department of Transportatior <br />oe, and it hereby is, requested to proceed with allocation of fund- <br />in, design and c~nstruction of Cedar Lane from High Street To West <br /> ~folk Road upgrade to four lanes divided as an urban road project: <br /> distance of approximately 1.2 miles. <br /> <br /> BE IT FURTHER RESOLVED that the Council of the City of Ports- <br /> ~th hereby agrees to pay its share of the total cost for prelimi- <br /> engineering, right-of-way and construction of this project in <br />accordance with Section 33.1-44, Code of Virginia, and that if the <br />City subsequently decides to cancel such construction after the <br />Department has initiated the pr6ject, the City ~agrees to reimburse <br />the Department the total amount of the costs expended by the Depart- <br /> through the date~he Department is notified of such cancella- <br />tion, and provided further that the Transportation Commission shall <br /> authority to waive all or any portion of such reimbursement at <br />its discretion." <br /> <br />Ayes: Barnes, Corprew, Gray, Lucas, Simpson, Webb, Holley <br />Nays: None <br /> <br /> On motion of Mr. Gray and seconded by Mrs. Webb, the following <br />'esolution was adopted, and by the following vote: <br /> <br />"A RESOLUTION R~QUESTING THE VIRGINIA DEPARTMENT OF <br />TRANSPORTATION TO PROCEED WITH ALLOCATION OF FUNDING, <br />DESIGN AND CONSTRUCTION OF CHURCHLAND BOULEVARD FROM <br />TOWNE POINT ROAD TO HIGH STREET WEST UPGRADE TO FOUR <br />LANES DIVIDED~UNDIVIDED AS AN URBAN ROAD PROJECT. <br /> <br /> WHEREAS, by agreement dated November 14, 1986, between the Cit~ <br /> Portsmouth and the Commonwealth of Virginia, Department of Trans <br />iDortation, certain urban road pro~ects were designated for funding, <br />esign and construction within the next five years; and <br /> <br /> WHEREAS, the Virginia Department of Transportation agreed, as <br />~rovided by law and Board policy, to allocate avalilable urban high~ <br />~ay funds for said projects; and <br /> <br /> WHEREAS, this Council deems it to be in the best interest of <br />the City to proceed immediately with the Churchland Boulevard Projec <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br /> Virginia, that the Virginia Department of Transportatio~ <br /> and it hereby is, requested to proceed with allocation of lundin <br />and construction of Chnrchland Boulevard from Towne Point <br />~ad to High Street upgrade to four lanes dividedZundivided as an <br />'ban road Froject, a distance of approximately 0.6~miles. <br /> <br /> BE IT FURTHER RESOLVED that the Council of the City of Ports- <br /> puth hereby agrees to pay its share of the total cost for prelimi- <br /> engineering, right-of-way and construction of this project in <br /> nce with Section 33.1-44, Code of Virginia, and that if the <br />subsequently decides to cancel such construction after the <br />)epartment has initiated the project, the City agrees to reimburse <br />zhe Department the total amount of the costs expended by the Depart- <br />aent through the date the Department is notified of such cancella- <br />tion, and provided further that the Transportation Commission shall <br /> ave authority to saive all or any portion of such reimbursement at <br /> discretion." <br /> <br />Ayes: Barnes, Corprew, Gray, Lucas, Simpson, Webb, Holle~ <br />Nays: None <br /> <br /> On motion of Mrs. Lucas and seconded by Mrs. Webb, the followi <br />~esolution was adopted, and by the following vote: <br /> <br /> <br />
