137 <br /> <br />December 9, 1986 <br /> <br />"A RESOLUTION REQUESTING THE VIRGINIA DEPARTMENT OF <br />TRANSPORTATION TO PROCEED WITH ALLOCATION OF FUNDING, <br />DESIGN AND CONSTRUCTION OF TURNPIKE ROAD FROM AIRLINE <br />BOULEVARD TO COUNTY STREET UPGRADE TO FOUR LANES UN- <br />DIVIDED AS AN URBAN ROAD PROJECT. <br /> <br /> WHEREAS, by agreement dated November 14, 1986, between the CitTM <br />f Portsmouth and the Commonwealth of Virginia, Department of <br />Transportation, certain urban road projects were designated for <br />ing, design and construction within the next five years; and <br /> <br /> WHEREAS, the Virginia Department of Transportation agreed, as <br />provided by law and Board policy, to allocate available urban high- <br />way funds for said projects; and <br /> <br /> WHEREAS, this Council deem iT to be in the best interest of the <br />City to proceed immediately with the Thrnpike Road Porject. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia, that the Virginia Department of Transportatim <br />be, and it hereby is, requested to proceed with allocation of <br />design and construction of Turnpike Road from Airline Boulevard to <br />County Street upgrade to four lanes undivided as an urban road proj~ <br />a distance of approximately 2.0 miles. <br /> <br /> BE IT FURTHER RESOLVED, that the Council of the City of <br />hereby agrees to pay its share of the total cost for preliminary <br />engineering, right-of-way and construction of this project in accor( <br />ance with Section 33.1-44, Code of Virginia, and that if the City <br />subsequently decides to cance] such construction after the Departme~ <br />has initiated the project, the City agrees to reimburse the Depart- <br />ment through the date the Department is notified of such cancellati~ <br />and provided further that th~ Transportation Commission shall have <br />authoirty to waive all or any portion of such reimbursement au its <br />discretion." <br /> <br /> Ayes: Barnes, Corprew, Gray, Lucas, Simpson, Webb, Holle~ <br /> Nays: None <br /> 86-456 - Letter from the City Manager recommending adoption of <br />a resolution expressing City CouncilTs concurrence with the resciss: <br />and termination of restrictions contained in a Declaration of <br />Restriction dated October 31, 1977. <br /> <br /> "At your Tuesday, November 25, 1986 CounciI meeting, a public <br />hearing was ccnducted to solicit citizen input regarding a request <br />from Associated Churchland Investors for City Council to rescind an~ <br />terminate restrictions for their property located off of Twin Pines <br />Road. <br /> <br /> At the public hearing no objects were received so, I, therefor~ <br />recommend that the Declaration of Restrictions be rescinded!." <br /> <br /> Louis Brenner, 600 Crawford Street, was available to speak <br />only if there was opposition. <br /> <br /> James N. Owens, 749 Boush Street, Norfolk, representing Hav~y <br />Lindsay Commercial Real Estate, was available to answer questions. <br /> <br /> On motion of Mr, Barnes and seconded by Mr. Gray, the followin <br />resolution was adopted, and by the following vote: <br /> <br />"A RESOLUTION EXPRESSING THE CONCURRENCE OF THE CITY COUNCIL <br />IN RESCISSION AND TERMINATION OF RESTRICTIONS CONTAINED IN A <br />DECLARATION OF RESTRICTIONS DATED OCTOBER 31, 1977; <br />AUTHORIZING THE CITY MANAGER TO SIGN A DEED OF RELEASE. <br /> <br /> <br />
