January 24, 2017 <br /> <br />Ayes: Cherry, Clark, Lucas-Burke, Moody, Psimas, Whitaker, Rowe <br />Nays: None <br /> <br />17 - 58 - Adoption of a resolution unconditionally authorizing the City Manager to <br />execute and deliver a Post-2018 Use and Support Agreement with the Southeastern <br />Public Service Authority for the use and support of a regional solid waste disposal <br />system. <br />Vision Principle: Efficient Service Delivery. <br /> <br />Background: <br /> <br />The Southeastern Public Service Authority (“SPSA”) is a political subdivision <br /> <br />created by statute to address regional solid waste disposal and consisting of member <br />localities Portsmouth, Chesapeake, Franklin, Norfolk, Suffolk, Virginia Beach, Isle of <br />Wight and Southampton. <br /> <br /> <br /> The current member locality Use and Support agreements with SPSA expire in <br />January 2018. <br /> <br /> All of the other member localities have entered into substantially identical “Post- <br />2018” Use and Support Agreements to support the ongoing operations of SPSA after <br />January 2018. <br /> <br /> City Council and the citizens have expressed concerns and aspirations about the <br />placement and engagement of facilities within the city. <br /> <br /> City Council has authorized the City Manager to engage SPSA in a discussion of <br />the provision of services cognizant of the present concerns and aspirations <br />notwithstanding prior conditions previously mentioned in Council Resolutions. <br /> <br />Discussion: <br /> <br /> By various Resolutions adopted in 2016, City Council authorized the City Manager <br />to execute a Post-2018 Use and Support Agreement, but the authority was subject to the <br />satisfaction of certain conditions. <br /> <br />City Council has expressed a desire to eliminate the conditions in the prior <br /> <br />Resolutions and unconditionally to authorize the City Manager to execute the Post-2018 <br />Use and Support Agreement with SPSA. <br /> <br /> <br />SPSA has expressed a commitment to eliminate all outstanding debt by 2018; to <br /> <br />reduce overall tipping fees for the member localities to the greatest extent practicable; to <br />ensure that private haulers are not offered lower tipping fees than the member localities; <br />and to follow the guiding principles expressed in the SPSA Strategic Operating Plan. <br /> <br /> <br />Financial Impact: <br /> <br />Executing the Post-2018 Use and Support Agreement will lock the City into the <br /> <br />regional tipping fee schedule and ensure that the City does not have to fund an alternative <br />solid waste system post 2018. <br /> <br /> <br />Staff Recommends: <br /> <br /> Adoption of the ordinance. Vision Principle: Efficient Service Delivery. <br /> <br />Next Steps Following Council Action: <br /> <br /> The City Manager will execute and deliver the Post-2018 Use and Support <br /> <br />Agreement with SPSA. <br /> <br />1. Mark Geduldig-Yatrofsky, P. O. Box 50141, spoke in support of this item but voiced <br /> his concern with the Use and Support Agreement Resolution adopted by the previous <br /> <br /> City Council. <br /> <br />Motion by Mr. Cherry, and seconded by Ms. Psimas, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />“RESOLUTION UNCONDITIONALLY AUTHORIZING THE CITY MANAGER TO <br />EXECUTE AND DELIVER A POST-2018 USE AND SUPPORT AGREEMENT WITH <br />THE SOUTHEASTERN PUBLIC SERVICE AUTHORITY FOR THE USE AND <br />SUPPORT OF A REGIONAL SOLID WASTE DISPOSAL SYSTEM. <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />
