January 24, 2017 <br /> <br /> WHEREAS, <br />the City of Portsmouth is a member of the Southeastern Public <br />Service Authority (“SPSA”), existing under statutory authority and consisting of the Cities <br />of Chesapeake, Franklin, Norfolk, Portsmouth, Suffolk and Virginia Beach and the <br />Counties of Isle of Wight and Southampton (“Member Localities”); and <br /> <br />WHEREAS, <br /> the Member Localities are parties to individual Use and Support <br />Agreements with SPSA providing for the disposal of municipal solid waste generated by <br />or collected in the SPSA service area; and <br /> <br />WHEREAS, <br /> all of the Use and Support Agreements that are currently operative <br />will expire on January 24, 2018; and <br /> <br />WHEREAS, <br /> the SPSA Board of Directors has approved the form of a Post-2018 <br />Use and Support Agreement to be entered into by all Member Localities to support the <br />ongoing operations of SPSA from and after January 25, 2018 (“Post-2018 Agreement”); <br />and <br /> <br />WHEREAS, <br /> on October 25, 2016 City Council adopted Resolution R-16-36, which <br />reaffirmed and adopted Resolution R-16-26, which itself had amended and restated <br />Resolution R-16-18 (collectively, the “Prior Resolutions”); and <br /> <br />WHEREAS, <br /> the Prior Resolutions authorized the City Manager to execute a Post- <br />2018 Agreement, but expressly conditioned the authority upon the satisfaction of certain <br />additional terms and requirements; and <br /> <br />WHEREAS, <br /> City Council now desires to revoke the additional terms and <br />requirements, and to authorize the City Manager, unconditionally, to execute and deliver <br />a Post-2018 Agreement with SPSA; <br /> <br />NOW, THEREFORE, BE IT RESOLVED <br /> by the Council of the City of Portsmouth, <br />Virginia that it is the intent of the City to remain a member of SPSA and to execute a Post- <br />2018 Agreement. <br /> <br /> BE IT FURTHER RESOLVED <br />that the Prior Resolutions (Resolution R-16-18, <br />Resolution R-16-26, and Resolution R-16-36) are hereby revoked and shall be null, void <br />and of no further force or effect. <br /> <br />BE IT FURTHER RESOLVED <br /> that the City Manager be, and she hereby is, <br />unconditionally authorized to execute and deliver on behalf of the City a Post-2018 <br />Agreement with SPSA.” <br /> <br />Ayes: Cherry, Clark, Lucas-Burke, Moody, Psimas, Rowe <br />Nays: Whitaker <br /> <br />- New Business - <br /> <br />17 - 59 - Boards and Commissions <br /> <br />Vice Mayor Cherry offered the following nominations: <br /> <br />Americans with Disabilities Commission <br />Tonya Jones to be reappointed to a term ending December 31, 2019. <br />Nancy Gresham to be reappointed to a term ending December 31, 2019. <br />Lois Rieckhoff to be reappointed to a term ending December 31, 2019. <br />Dr. Jaclyn Walker to be reappointed to a term ending December 31, 2019. <br />Lisa Kidd to be appointed to fill a term ending December 31, 2017, replacing Darlene <br />Mueller. <br />G.
