December 13, 2016 Recommended Action:  Adoption of the ordinance. Vision Principles: Sustainable Neighborhoods, Enhanced Quality of Life, and Efficient Service Delivery. Next Steps Following Council Action:  Finance will complete the necessary budgetary adjustments. Motion by Mr. Moody, and seconded by Ms. Psimas, to adopt the following ordinance, and was adopted by the following vote: “ORDINANCE ACCEPTING FUNDING IN THE AMOUNT OF $62,963 FROM THE VIRGINIA DEPARTMENT OF SOCIAL SERVICES AND APPROPRIATING SAID AMOUNT IN THE FY 2017 SOCIAL SERVICES FUND FOR USE BY THE DEPARTMENT OF SOCIAL SERVICES IN CONNECTION WITH THE FINAL TRANSITIONING OF ALL CLIENT CASES TO THE VIRGINIA CASE MANAGEMENT SYSTEM.” Ayes: Cherry, Edmonds, Moody, Psimas, Whitaker, Wright Nays: None 16 - 373 - Adoption of an ordinance to amend Article III of Chapter 36 of the Code of the City of Portsmouth, Virginia (2006) (Tree Planting and Replacement) by amending and reordaining subsections 36-52(1), (3) and (4), Section 36-56, and Table 36.1 for the purposes of correcting certain references to the Zoning Ordinance, the Subdivision Ordinance, and other governing documents, and designating the Board of Zoning Appeals as the venue for appeals of determinations made under the Article. Vision Principles:Sustainable Neighborhoods, Enhanced Quality of Life, and Efficient Service Delivery. Background:  The Zoning Ordinance was updated in 2010 which resulted in changes to the zoning districts.  The Tree Planting and Replacement Ordinance uses the zoning districts to determine the requirements for tree planting. Discussion:  In the current Zoning Ordinance, several of the old zoning districts were consolidated under a single new zone. Some of the old zones were deleted entirely. Some new ones were added.  The proposed changes reconcile the requirements in Table 36.1 with the changes.  The proposed changes update the references to the subdivision ordinance and the zoning ordinance with the current section numbers.  The proposed changes update the reference documents for selecting approved trees and delete documents that are no longer available.  The proposed changes make the Board of Zoning Appeals the authority that can hear appeals.  The regulatory requirements for the respective zones remain unchanged. Financial Impact:  It is anticipated that there will be no additional costs related to these changes. Recommended Action:  Adoption of the amended ordinance.
