167 <br /> <br />January 27, 1987 <br /> <br /> WHEREAS, the developer is aware that building permits or any <br />~ther required permit will be issued only upon compliance with the <br />~rdinances, laws, or regulations applicable thereto. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia that the certain group housing project describe <br />above and designated as GHP-86-18 and more specifically described <br />in correspondence from Kirk Berkeley, A.I.A., dated November 5, 1986 <br />as shown on plans designated "Morlino Condominium" filed with the <br />appropriate officials of the City 6f Portsmouth, Virginia, such <br />nade a part hereof, is hereby granted approval subject to tie <br />lng terms and conditions: <br /> <br /> 1. The property behind "Building O~e" and the property line <br />the western edge of the parking lot be screened from the adjacent <br />property with a proper vegetative screen to be approved by the Down- <br />town Design Committee. <br /> <br /> 2. The parking lct, walkways and <br />~ccordance with the final design to be <br />Design Committee. <br /> <br />building entrances be lit in <br />approved by the Downtown <br /> <br /> 3. The internal walkway system be either brick or a coDcr~te/ <br />brick combination in accordance with the final design to be approvec <br />by the Downtown Design Committee. <br /> <br /> 4. A Certificate of Compliance be obtained from the Downtown <br />Design Committee prior ~o the issuance of a building permit. <br /> <br /> ~mprovement plan be submitted to thb Depart <br /> S. A standard site ' <br />ment of Engineering and Technical Services for review and approval. <br /> <br /> 6. Demolition of 520-22 and 524-26 Columbia Street proceed <br />only upon the effective date of this resolution and after all neces- <br />sary building, engineering, and other permits are obtained." <br /> <br />"A RESOLUTION GRANTING APPROVAL OF A GROUP HOUSING <br />PROJECT PURSUANT TO SECTION 40-55 OF THE CODE OF <br />THE CITY OF PORTSMOUTH, VIRGINFA, 1973, SAID PROJEST <br />CONSISTING OF A FOUR (4) UNIT CONDOMINIUM ON THE <br />WESTERN TERMINUS OF BAYVIEW BOULEVARD AND DESIGNATED <br />AS (GHP-87-1). <br /> <br /> f WHEREAS, T. A. Edwards has made appl%cation pursuanz to ~40-5S <br /> the Eode of the City of Portsmouth, Virginia, 1973, for the <br />granting and approval of a group housing project consisting of four <br />(4) conRominium units in two structures at 3013 Bayview Boulevar~ <br />Tax Plate 182, Parcels 2 and ~); and <br /> <br /> WHEREAS, the application has been determined by the Plannim~ <br /> omm~ss~on! to have met the requirements of §40-5S; and / <br /> WHEREAS, the Planning Commission has reviewed such application~ <br />and sit~ plans submitted therewith anJ has recommended conditional <br />approval of said application; and <br /> <br /> WHEREAS, the developer has been informed that approval of a <br />group housing project pursuant to §40-S5 g ants only an exemption <br />from certain requirements for residences as stated in said section <br />and ........... does not constitute a waiver of anv~ other, requirement embodied <br />~n ~ne ~uoazvzsmon Ordinance, Zoning Ordinance, Code of the City of <br />~ortsmouth, Virginia, or any other applicable local, state o~ f~d <br />law or regulation; and <br /> <br /> WHEREAS, the developer is aware that building permits o{ any <br />pther required permi~ will be issued only upon compliance w~th t~e <br />~rdinances, laws, or regulations applicable thereto. <br /> <br /> <br />
