Approval for construction with ~he City of Norfolk and C & <br />~tility easements be obtained and submitted for review and approval <br />to the Department of Engineering and Technical Servxces. <br /> <br /> 2. A standard site improvement plan must be submitted to the <br />Department of Engineering and Technical Services for review and <br />approval which includes the proposed access from Haysom Street. <br /> <br /> 3. An mnstrument in form and content approved by the City <br />Attorney duly executed and acknowledged which restricts the group <br />housing project to being housing for the elderly as defined by <br /> 0-31 of the City Code, such instrument to be properly recorded in <br /> Clerk's C£fice of the Circuit Court of the City of Portsmouth, <br />Virginia. <br /> <br /> (e) "A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING <br /> PROJECT PURSUANT TO SECTION 40-55 OF THE CCDE OF <br /> THE CITY OF PORTSMOUTH, VIRGINIA, 1973, SAID PROJECT <br /> CONSISTING OF TWO (2) THREE-STORY STRUCTURES WITH <br /> FIFTEEN (15) CONDOMINIUM UNITS ON .44 ACRES ON THE <br /> NORTHERN SIDE OF THE 500 BLOCK OF COLUMBIA STREET <br /> AND DESIGNATED AS (GHP-86-18). <br /> <br /> WHEREAS, William Morlino, owner, represented by Kirk Berkeley, <br />A.I.A., has made application pursuant to ~40-55 of the Code of the <br />City of Portsmouth, Virginia, 1973, for the granting and approval <br />of a group housing project consisting of fifteen (15) units contain~ <br />in two (2) three-story buildings located on the northern side of th~ <br /> 00 block of Columbia Street (Tax Map 13, Parcels 51, 52, 53, 55, 5¢ <br /> and 67) and designated GHP-86-18; and <br /> <br /> WHEREAS, the application has been determined by the Planning <br /> .ommission to have met the requirements of ~4q-55 of the Eode of <br /> he City of Portsmouth, Virginia, 1973, as amended; and <br /> <br /> WHEREAS, the Planning Commission has reviewed said application <br /> site plans submitted ~herewith and has recommended a conditiona <br /> ~pproval of same; and <br /> <br /> WHEREAS, the developer has been informed that approval of a <br /> group housing project pursuant to ~40-55 grants only and exemption <br /> from certain requirements £or residences as stated mn said section <br /> and does not constitute a waiver of any other requirement embodied <br /> in the Subdivision Ordinance, Zoning Ordinance, Code of ~he City of <br /> Portsmouth, Virginia, or any other applicable local, state or <br /> federal law or regulation; and <br /> <br /> <br />
