October 11, 2016 “ORDINANCE ACCEPTING GRANT FUNDS IN THE AMOUNT OF $65,805 FROM THE U.S. DEPARTMENT OF JUSTICE BUREAU OF JUSTICE ASSISTANCE AND APPROPRIATING SAID FUNDS IN THE FY 2017 GRANTS FUND FOR USE BY THE PORTSMOUTH POLICE DEPARTMENT TO PURCHASE BULLETPROOF VESTS FOR POLICE AND SHERIFF PERSONNEL.” Ayes: Cherry, Moody, Psimas, Whitaker, Wright Nays: None - New Business - 16 - 312 - Boards and Commissions There were no appointments. 16 - 328 - Items Submitted by Council Members Adoption of a resolution adopting a Minority and Women Business Enterprise (MWBE) Inclusion Policy for the City of Portsmouth, Virginia. 1. Tracy Link, 3412 Race Street, spoke in support of this item. 2. Donna Sayegh, 3104 Garland Drive, spoke in opposition to this item. 3. Gary McCollum, 3901 Meeting House Road, Virginia Beach, spoke in support of this item. Motion by Dr. Whitaker, and seconded by Ms. Psimas, to adopt Minority and Women Business Enterprise (MWBE) Inclusion Policy with the amended language of the last sentence in Section 2 to read “The Disparity Study recommended the development of a MWBE program to include the following elements but not limited to” and was adopted by the following vote: Ayes: Cherry, Moody, Psimas, Whitaker, Wright Nays: None Motion by Dr. Whitaker, and seconded by Mr. Cherry, to adopt the following resolution pertaining to MWBE Inclusion Policy with the above addition and the addition of Section VII under Item A to read “Bids not complying with MWBE guidelines shall be deemed non responsive”, and was adopted by the following vote: “RESOLUTION ADOPTING A MINORITY AND WOMEN BUSINESS ENTERPRISE (MWBE) INCLUSION POLICY FOR THE CITY OF PORTSMOUTH, VIRGINIA. WHEREAS, in September 2013 the City of Portsmouth retained MGT of America, Inc. to conduct a Procurement Disparity Study; and WHEREAS, the Procurement Disparity Study found that statistically significant disparities exist between the availability and utilization of minority and women owned businesses both in City contracting and in the private sector; and WHEREAS, the Procurement Disparity Study recommended the adoption of race and gender conscious measures which are narrowly tailored to address the Study’s findings; and WHEREAS, in accordance with the Study’s recommendation, a draft Minority and Women Business Enterprise (WMBE) Inclusion Policy has been prepared, and Council has reviewed the draft Policy; NOW THEREFORE BE IT RESOLVED by the Council of the City of Portsmouth, Virginia that the City of Portsmouth Minority and Women Business Enterprise Inclusion Policy is hereby adopted in the form attached hereto as Exhibit A; and
