September 27, 2016 <br /> <br />(f) Maintains safe and adequate egress and ingress onto the site, and safe road <br />conditions around the site; <br /> <br />(g) Allows for the protection of property values and the ability of neighboring lands to <br />develop the uses permitted in the zoning districts; and <br /> <br />(h) Complies with all other city, state, and federal laws and regulations. <br /> <br /> 2. That Will Washington Construction, LLC is hereby granted a use permit <br />pursuant to Section 40.1-2.3(B) of the Code of the City of Portsmouth, Virginia (2006) to <br />construct a three dwelling unit residential development at 601 Jamestown Avenue, <br />Portsmouth, Virginia, being more particularly described as: <br /> <br />UP-16-09 <br /> <br />601 Jamestown Avenue <br />(Tax Parcel 0169-0400) <br /> <br />ALL THAT certain lot, piece or parcel of land, with the buildings and improvements <br />thereon, situate, lying and being in the City of Portsmouth, Virginia and being known, <br />numbered and designated as Lot A, as shown on that certain plat entitled “Resubdivision <br />of 2 Lots on Plat 3 Jane Cassells Estate, Located Between Scotts Creek and Sixth Street <br />(M.B. 1, PG. 41), which said plat is duly recorded in the Clerk’s Office of the Circuit Court <br />of the City of Portsmouth, Virginia, in Map Book 24, at page 107. <br /> <br />BEING the same real estate conveyed to Will Washington Construction, LLC, by deed <br />from Gary S. Muhammad, dated May 26, 2016 and recorded in the Portsmouth Circuit <br />Court Clerk’s Office as Instrument Number 160005221. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) The development of the site shall be in substantial conformity with those certain <br />plans and elevations labeled “Proposed Front Elevations”, “Proposed Floor Plan” , <br />“Proposed Rear Elevation”, “Proposed Left Elevation”, and “Proposed Right Elevation”, <br />which were submitted as part of the Use Permit application and appended to the Planning <br />Commission staff report, except as may be necessary to comply with any modifications <br />required by City Ordinances and the City Code during site plan review and approval, and <br />further except: <br /> <br />(i) Two large canopy trees shall be planted in the rear yard, in accordance with the <br />requirements of Part 506 of the D2 Form Based Code (“D2 FBC”); <br /> <br />(ii) The building materials shall be listed and shown on the proposed elevations for <br />the Site Plan Review Process, and shall be in accordance with all applicable requirements <br />of the D2 FBC; <br /> <br />(iii) No wall along Jamestown Avenue shall have a blank area longer than 15 feet; <br /> <br />(iv) A minimum of 20% of the required fenestration along Jamestown Avenue shall be <br />comprised of glass; <br /> <br />(v) A street wall with a height between four feet and eight feet shall be installed along <br />any sections of King Street and Jamestown Avenue that are not occupied by building <br />frontage or driveway. The wall material shall be one of those listed in Part 404 of the D2 <br />FBC; and <br /> <br />(vi) At least 850 square feet of contiguous open space shall be provided behind the <br />thirty-foot parking setback line. <br /> <br />(b) All taxes/fees associated with the property and/or the proposed use shall be paid <br />when due. <br /> <br /> <br /> <br /> <br />
