<br />At a Regular Meeting of the City Council on Tuesday, September 27, 2016, there
<br />were present:
<br />
<br />Mayor Kenneth I. Wright, Vice Mayor Elizabeth M. Psimas, William E. Moody, Jr., Paige
<br />D. Cherry, Dr. Curtis E. Edmonds, Sr., Dr. Mark M. Whitaker, City Manager Dr. L. Pettis
<br />Patton, City Attorney Solomon H. Ashby, Jr.
<br />
<br />Councilman Curtis E. Edmonds, Sr., opened the meeting with prayer, which was
<br />followed by the Pledge of Allegiance to the Flag.
<br />
<br /> Mayor Wright called the meeting to order and welcomed all in attendance.
<br />
<br /> Motion by Mr. Moody, and seconded by Dr. Edmonds, to approve the minutes of
<br />a Called Meeting of September 13, 2016, of a Regular Meeting of September 13, 2016,
<br />and of a Called Meeting of September 19, 2016, and was adopted by the following vote:
<br />
<br />Ayes: Cherry, Edmonds, Moody, Psimas, Whitaker, Wright
<br />Nays: None

<br /> Unfinished Business
<br />
<br />16 - 283 - Use permit, rezoning and code amendment:
<br />
<br />
<br /> Motion by Dr. Whitaker, and seconded by Mr. Moody, to adopt the following
<br />resolution approved on first reading at the September 13, 2016 meeting, and was adopted
<br />by the following vote:
<br />
<br />16-283(b):
<br />
<br />“RESOLUTION GRANTING A USE PERMIT (UP-16-09) TO WILL WASHINGTON
<br />CONSTRUCTION, LLC TO CONSTRUCT A THREE DWELLING UNIT RESIDENTIAL
<br />DEVELOPMENT AT 601 JAMESTOWN AVENUE.
<br />
<br />
<br />WHEREAS,
<br /> Will Washington Construction, LLC, the owner of the subject property,
<br />by and through its agent Home Builders I, Inc., has made application pursuant to Section
<br />40.1-2.3B of the Code of the City of Portsmouth, Virginia (2006) for the granting of a use
<br />permit to construct a three dwelling unit residential development at 601 Jamestown
<br />Avenue, Portsmouth, Virginia; and
<br />
<br />WHEREAS
<br /> , the applicant and the Planning Director have done all things required
<br />to be done in connection with said application; and
<br />
<br />WHEREAS
<br /> , the Planning Commission has recommended the granting of the
<br />application for a use permit with conditions.
<br />
<br />NOW, THEREFORE, BE IT RESOLVED
<br /> by the Council of the City of Portsmouth,
<br />Virginia:
<br />
<br /> 1. That it finds that the use for which the permit is sought:
<br />
<br />(a) Complies with the applicable standards of the Zoning Ordinance;
<br />
<br />(b) Is consistent with the comprehensive plan;
<br />
<br />(c) Is compatible with the character of surrounding lands and the uses permitted in the
<br />zoning district(s) of surrounding lands;
<br />
<br />(d) Is configured to minimize adverse effects, including the visual impacts of the
<br />proposed use on adjacent lands;
<br />
<br />(e) Avoids significant deterioration of water and air resources, and other natural
<br />resources;
<br />
<br />
