September 13, 2016 <br /> <br />(e) Avoids significant deterioration of water and air resources, and other natural <br />resources; <br /> <br />(f) Maintains safe and adequate egress and ingress onto the site, and safe road <br />conditions around the site; <br /> <br />(g) Allows for the protection of property values and the ability of neighboring lands to <br />develop the uses permitted in the zoning districts; and <br /> <br />(h) Complies with all other city, state, and federal laws and regulations. <br /> <br /> 2. That Raquel S. Owens is hereby granted a use permit pursuant to Section <br />40.1-2.3(B) of the Code of the City of Portsmouth, Virginia (2006) to operate a family <br />child day care home at 3511 Pierce Street, Portsmouth, Virginia, being more particularly <br />described as: <br /> <br />UP-16-05 <br /> <br />3511 Pierce Street <br />(Tax Parcel 0827-0770) <br /> <br />ALL THAT certain lot, piece or parcel of land, with the buildings and appurtenances <br />thereunto belonging, situate, lying, being in the City of Portsmouth, Virginia and being <br />known, numbered and designated as Lot 63A on that certain plat entitled <br />“SUBDIVISION OF LOTS 63 & 66, MR. WM F. WISE’S CHURCHLAND PROPERTY <br />(M.B. 3, P. 7 CHES), PORTSMOUTH, VIRGINIA”, dated December 17, 2013, made by <br />Beck Associates and duly recorded in the Clerk’s Office of the Circuit Court of the City <br />of Portsmouth, Virginia in Map Book 23 at Page 207. <br /> <br />BEING the property conveyed to Raquel S. Owens by Deed of Bargain and Sale from <br />Tiger Johnson, LLC, a Virginia limited liability company, dated November 6, 2014 and <br />recorded in the Portsmouth Circuit Court Clerk’s Office as Instrument Number <br />140010974. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) The facility shall be limited to providing care for no more than eight (8) children. <br /> <br />(b) The days and hours of operation for the family child day care home shall be <br />limited to Monday through Friday commencing no earlier than 5:00 a.m. and ending no <br />later than 8:30 p.m. Overnight care shall be prohibited. <br /> <br />(c) Outdoor play shall be limited to Monday through Friday no earlier than 8:00 a.m. <br />to no later than 6:00 p.m. <br /> <br />(d) At least four (4) driveway parking spaces in support of the family child day care <br />home shall be maintained during days and hours of operation. <br /> <br />(e) The facility shall be operated in compliance with all applicable codes, ordinances <br />and regulations of federal, state and local government and all required licenses and <br />permits shall be obtained and remain in effect during the operation of the family child <br />day care home. <br /> <br />(f) All taxes/fees associated with the property and/or the proposed use shall be paid <br />when due. <br /> <br />REVOCATION OF PERMIT: <br />4.
