September 13, 2016 <br /> <br />Ayes: Cherry, Edmonds, Meeks, Moody, Psimas, Whitaker, Wright <br />Nays: None <br /> <br />(e) CA-16-01 CITYWIDE - The City of Portsmouth is proposing amendments to <br />the Zoning Ordinance pertaining to Waste Related Services <br />including the definitions, use types, Use Table, and standards of <br />the Ordinance to address Transfer Station facilities and <br />Construction, Demolition, Debris (CDD) Landfills. These uses <br />would be allowed in the Industrial (IN) district only after obtaining a <br />use permit from City Council. These amendments would not apply <br />to any existing facilities, and are necessary in anticipation of <br />changes in the regional solid waste services in Portsmouth. Vision <br />Principle A Robust and Prospering Economy. <br /> <br />There were no speakers. <br /> <br />Motion by Mr. Meeks, and seconded by Dr. Edmonds, to concur with the <br />recommendation of the Planning Commission that CA-16-01 be approved on first <br />reading, and was adopted by the following vote: <br /> <br />Ayes: Cherry, Edmonds, Meeks, Moody, Psimas, Whitaker, Wright <br />Nays: None <br /> <br />- Unfinished Business - <br /> <br />16 - 249 - use permit: <br /> <br /> Motion by Dr. Whitaker, and seconded by Ms. Psimas, to adopt the following <br />resolution approved on first reading at the August 9, 2016 meeting, and was adopted by <br />the following vote: <br /> <br />16-249 (a): <br /> <br />“RESOLUTION GRANTING A USE PERMIT (UP-16-05) TO RAQUEL S. OWENS TO <br />OPERATE A FAMILY CHILD DAY CARE HOME AT 3511 PIERCE STREET. <br /> <br /> <br />WHEREAS, <br /> Raquel S. Owens, the owner of the subject property, has made <br />application pursuant to Section 40.1-2.3B of the Code of the City of Portsmouth, Virginia <br />(2006) for the granting of a use permit to operate a family child day care home at 3511 <br />Pierce Street, Portsmouth, Virginia; and <br /> <br />WHEREAS <br /> , the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br />WHEREAS <br /> , the Planning Commission has recommended the granting of the <br />application for a use permit with conditions. <br /> <br />NOW, THEREFORE, BE IT RESOLVED <br /> by the Council of the City of <br />Portsmouth, Virginia: <br /> <br /> 1. That it finds that the use for which the permit is sought: <br /> <br />(a) Complies with the applicable standards of the Zoning Ordinance; <br /> <br />(b) Is consistent with the comprehensive plan; <br /> <br />(c) Is compatible with the character of surrounding lands and the uses permitted in <br />the zoning district(s) of surrounding lands; <br /> <br />(d) Is configured to minimize adverse effects, including the visual impacts of the <br />proposed use on adjacent lands; <br /> <br /> <br /> <br /> <br /> <br />
