September 13, 2016 Ayes: Cherry, Edmonds, Meeks, Moody, Psimas, Whitaker, Wright Nays: None (e) CA-16-01 CITYWIDE - The City of Portsmouth is proposing amendments to the Zoning Ordinance pertaining to Waste Related Services including the definitions, use types, Use Table, and standards of the Ordinance to address Transfer Station facilities and Construction, Demolition, Debris (CDD) Landfills. These uses would be allowed in the Industrial (IN) district only after obtaining a use permit from City Council. These amendments would not apply to any existing facilities, and are necessary in anticipation of changes in the regional solid waste services in Portsmouth. Vision Principle A Robust and Prospering Economy. There were no speakers. Motion by Mr. Meeks, and seconded by Dr. Edmonds, to concur with the recommendation of the Planning Commission that CA-16-01 be approved on first reading, and was adopted by the following vote: Ayes: Cherry, Edmonds, Meeks, Moody, Psimas, Whitaker, Wright Nays: None - Unfinished Business - 16 - 249 - use permit: Motion by Dr. Whitaker, and seconded by Ms. Psimas, to adopt the following resolution approved on first reading at the August 9, 2016 meeting, and was adopted by the following vote: 16-249 (a): “RESOLUTION GRANTING A USE PERMIT (UP-16-05) TO RAQUEL S. OWENS TO OPERATE A FAMILY CHILD DAY CARE HOME AT 3511 PIERCE STREET. WHEREAS, Raquel S. Owens, the owner of the subject property, has made application pursuant to Section 40.1-2.3B of the Code of the City of Portsmouth, Virginia (2006) for the granting of a use permit to operate a family child day care home at 3511 Pierce Street, Portsmouth, Virginia; and WHEREAS , the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS , the Planning Commission has recommended the granting of the application for a use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That it finds that the use for which the permit is sought: (a) Complies with the applicable standards of the Zoning Ordinance; (b) Is consistent with the comprehensive plan; (c) Is compatible with the character of surrounding lands and the uses permitted in the zoning district(s) of surrounding lands; (d) Is configured to minimize adverse effects, including the visual impacts of the proposed use on adjacent lands;
