181 <br /> <br />February 10, 1987 <br /> <br />Lhe development area. The cost of installation of the utility ser- <br />vice shall be paid by the developer and thereafter maintained by thc <br />City. <br /> <br /> CSX Transportation, Inc., has agreed to issue a right-of-way ar <br />license for the crossing of its rail line by the water and utility <br />services. The utilities will be installed pursuant to regulations <br />for such construction set forth by the railroad. <br /> <br /> I recommend adoption of the resolution authorxzing the City <br />Manager to enter into an agreement with Sweetbriar Development Cor- <br />poration and CSX Transportation, Inc., for the installation and <br />maintenance of the water and sewer utility services for this <br />merit. <br /> <br /> On motion of Mrs. Webb and seconded by Mrs. Lucas, the follow- <br />ing resolution was adopted, and by the following vote: <br /> <br />"A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INT0 <br />AGREEMENTS WITH SWEETBRIAR DEVELOPMENT CORPORATION AND <br />CSX TRANSPORTATION, INC., FOR INSTALLATION OF A WATER <br />LINE AND SANITARY SEWER LINE. <br /> <br /> WHEREAS, Sweebriar Development <br />certain property in the vicinity of <br />Court as a commercial and industrial <br />as Greenwood Industrial Park; and <br /> <br />Corporation desires to develop <br />Seaguard Avenue and Bedford <br />development area to be known <br /> <br /> WHEREAS, said development requires the extension of sanitary <br />sewer and water utility services to the subject property; and <br /> <br /> WHEREAS, the extension of said utility services will be under <br />and across the railroad lines of CSX Transportation, Inc.,; and <br /> <br /> WHEREAS, the cost Of installation of said utility lines shall <br />be paid by the developer, after which said utility lines shall be <br />dedicated to and maintained by the City of Portsmouth; and <br /> <br /> WHEREAS, said utility lines shall be installed pursuant to the <br />construction requirements of CSX Transportation, Inc.; and <br /> <br /> WHEREAS, pursuant to said terms, CSX Transportation, <br />agreed to issue a license and right-of-way for the purpose <br />stalling and maintamn~ng said utility service lines. <br /> <br />I~o~'~n-: has <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia, that the City Manager be, and he hereby is, <br />authorized to enter into agreements with Sweetbriar Development <br />Corporation and CSX Transportation, Inc., for the purpose o~ instal <br />ling, operating and maintaining an eight inch potable water line <br />and a sanitary sewer main over, under and across the property of CS <br />Transportati0~, Inc., at a point 2,756.73-2,766.73 feet sou~heast- <br />wardly measured along the center line of CSX main track from mile- <br />post SA-6." <br /> <br />Ayes: Corprew, Gray, Lucas, SimFson, Webb, Holley <br />Nays: None <br /> <br /> 87-47 <br />a resolution <br />Park. <br /> <br />Letter from the City Manager recommending adoption of <br />~o abandon a utility easement in Beechdale Commerce <br /> <br /> "The Portsmouth Industrial Development Authority (PIDA) is <br />preparing to sell several parcels of land in Beechdale Commerce <br />Park. Prior to doing so, PIDA would like to vacate a utility ease- <br />ment which is no longer needed and which hampers development of one <br />of the sites. <br /> <br /> <br />
