CSX Transportation, Inc., has agreed to issue a right-of-way ar license for the crossing of its rail line by the water and utility services. The utilities will be installed pursuant to regulations for such construction set forth by the railroad. I recommend adoption of the resolution authorxzing the City Manager to enter into an agreement with Sweetbriar Development Cor- poration and CSX Transportation, Inc., for the installation and maintenance of the water and sewer utility services for this merit. On motion of Mrs. Webb and seconded by Mrs. Lucas, the follow- ing resolution was adopted, and by the following vote: "A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INT0 AGREEMENTS WITH SWEETBRIAR DEVELOPMENT CORPORATION AND CSX TRANSPORTATION, INC., FOR INSTALLATION OF A WATER LINE AND SANITARY SEWER LINE. WHEREAS, Sweebriar Development certain property in the vicinity of Court as a commercial and industrial as Greenwood Industrial Park; and Corporation desires to develop Seaguard Avenue and Bedford development area to be known WHEREAS, said development requires the extension of sanitary sewer and water utility services to the subject property; and WHEREAS, the extension of said utility services will be under and across the railroad lines of CSX Transportation, Inc.,; and WHEREAS, the cost Of installation of said utility lines shall be paid by the developer, after which said utility lines shall be dedicated to and maintained by the City of Portsmouth; and WHEREAS, said utility lines shall be installed pursuant to the construction requirements of CSX Transportation, Inc.; and WHEREAS, pursuant to said terms, CSX Transportation, agreed to issue a license and right-of-way for the purpose stalling and maintamn~ng said utility service lines.
