Davis, 3708 Summer Place, Virginia Beach, VA, was <br />~resent to answer questions. <br /> <br />Motion of Mr. Gray and seconded by Mr. Simpson, to con~ur in <br />,he recommendation of the Plannmng Commission, UP 87-3 for a day cas <br />center on the former Truxton School property at the southeast corne~ <br />~f Portsmouth and Deep Creek Boulevards, was approved on first <br /> g, and was adopted by unanimous vote. <br /> <br />UNFINISHED BUSINESS - <br /> <br />Consent Agenda <br /> <br />87-27 Gronp--h~using~applieat£on: <br /> <br />"RESOLUTION AMENDING THE APPROVAL GRANTED FOR A <br />GROUP HOUSING PROJECT PURSUANT TO SECTION 40-SS <br />OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA <br />1975, SAID PROJECT BEING KNOWN AS 'PEPPERWOOD I <br />AND DESIGNATED AS GHP-SS-8. <br /> <br /> WHEREAS, the Council of the City of Portsmouth, Virgini <br />~dopted at a meeting held May 28, 1985 a resolution granting <br />for a group housing project pursuant to ~40-5S of the Code o <br />City of Portsmouth, Virginia, 1973, said project being known <br />PEPPERWOOD III' and designated as GHP-85-8 and consisting o <br />;even (97) townhouse-style apartments on 6.96 acres located <br />Pepperwood Court and the proposed Western Freeway; and <br /> <br />to <br /> <br /> WHEREAS, Benjamin J. Levy, attorney for James B. Bickfo <br /> application purusanz to ~40-55 of the Code of the City <br /> Virginia, 1973, for a revision to the conditions stta <br />said group housing project approval; and <br /> <br /> WHEREAS, the condition in question pertains to access z~ <br />subject project and its deletion is being requested as a res~ <br />the construction of the Western Freeway; and <br /> <br />.: the <br /> as <br /> <br />'d, has <br />)f <br />:bed <br /> <br />~ the <br /> <br /> WHEREAS, the Planning Commission has reviewed such appl.cation <br /> for revismon and has made a recommendation thereon; and <br /> <br /> WHEREAS, the developer is aware that approval of the re~'ision <br />requested would not constitute a waiver of any other require~lent <br />embodied in the Subdivision Ordinance, Zoning Ordinance, or Iiode of <br />the City of Portsmouth, Virginia or any other applicable loc~ <br /> federal law or regulation, and that all the remaining ter~ts'and <br /> ons of the group housing project approval would remai~ in fu] <br /> and effect. <br /> <br /> NOW, THEREFCRE, BE IT RESOLVED by the Council of the Cil o£ <br />)ortsmouth, Virginia that the resolution approved by the Cou~.cil of <br />theTCity of Portsmouth, Virginia on May 28, 1985 granting aptroval <br />for group housing project-(GHP-SS-8) known as ~Pepperwood IIJ' is <br />hereby revised to delete condition (4) as provided in said resolutic <br />and <br /> <br /> BE IT FURTHER RESOLVED that all remaining terms an~ conditions <br />of t~e sroup housing project as approved by said resolution ~hall <br /> mn ful] force and effect." <br /> <br /> <br />
