February 23, 2016 <br /> <br />(d) Is configured to minimize adverse effects, including the visual impacts of the <br />proposed use on adjacent lands; <br /> <br />(e) Avoids significant deterioration of water and air resources, and other natural <br />resources; <br /> <br />(f) Maintains safe and adequate egress and ingress onto the site, and safe road <br />conditions around the site; <br /> <br />(g) Allows for the protection of property values and the ability of neighboring lands to <br />develop the uses permitted in the zoning districts; and <br /> <br />(h) Complies with all other city, state, and federal laws and regulations. <br /> <br /> 2. Portsmouth Redevelopment and Housing Authority is hereby granted a <br />use permit pursuant to Section 40.1-2.3(B) of the Code of the City of Portsmouth, <br />Virginia (2006) for the construction of multi-family housing at 1 Lexington Drive, <br />Portsmouth, Virginia, said property being more particularly described as: <br /> <br />UP-16-01 <br /> <br />1 Lexington Drive <br />(Tax Parcel 0145-0010) <br /> <br />ALL THOSE CERTAIN lots, pieces or parcels of land, being, lying and situate in the City <br />of Portsmouth, Virginia, known as the Lincoln Park public housing community property <br />and generally described as follows: <br /> <br />COMMENCING at the northeast intersection of Deep Creek Boulevard and Graham <br />Street; thence northeasterly along the northern line of Deep Creek Boulevard to the <br />northwest intersection of Deep Creek Boulevard and Columbus Avenue; thence <br />northwesterly along the western line of Columbus Avenue, inclusive of the closed right <br />of way formerly known as Lexington Drive, to the southeastern corner of the Dale <br />Homes public housing community (2300 Columbus Avenue, Tax Parcel 0167-0040); <br />thence westerly along the southern line of the Dale Homes public housing community to <br />the northeastern terminus of Graham Street; thence southeasterly along the eastern line <br />of Graham Street to the northeast intersection of Deep Creek Boulevard and Graham <br />Street, the point of beginning. <br /> <br />BEING the Lincoln Park public housing community property. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) The development of the site shall be in substantial conformity with the concept <br />plan titled Development of Lincoln Park prepared by Saunders and Crouse submitted <br />with the Use Permit application (undated) and on file in the Department of Planning, <br />except as may be necessary to comply with any modifications required by City <br />Ordinances and the City Code during site plan review and approval. <br /> <br />(b) The design and materials of buildings constructed in Lincoln Park/Lexington shall <br />be in substantial conformity with the “Perspective-Building Type I and Type II” prepared <br />by Saunders & Crouse and on file in the Department of Planning. <br /> <br />(c) All current requirements of the Zoning Ordinance, City Code, and other <br />applicable laws or regulations shall apply to the redevelopment of Lincoln <br />Park/Lexington. <br /> <br />(d) All taxes/fees associated with the property and/or the use shall be paid when <br />due. <br /> <br />REVOCATION OF PERMIT: <br />4. Violation of any of the above conditions may <br /> <br />serve as grounds for revocation of the use permit by City Council.” <br /> <br /> <br /> <br />
