February 23, 2016 <br /> <br />(c) The development shall be submitted for Site Plan Review, administered through <br />the Engineering Department. <br /> <br />(d) The applicant shall obtain a sign permit for all proposed signage additions and <br />amendments. <br /> <br />(e) The development shall comply with Portsmouth City Code Section 40.1-6.6 <br />(Nonconforming Site Aspects), including a formal review of off-street parking, <br />landscaping, screening of mechanical equipment and screening walls/fences by the <br />Zoning Administrator. <br /> <br />(f) The development shall comply with Portsmouth City Code Section 40.1-9 <br />(Appendix B), Uptown D-2 District Form-Based Code. The colors in the proposed <br />standing seam metal mansard canopy roof and brick columns shall closely match the <br />colors present in the existing 7-Eleven convenience store. <br /> <br />(g) The facility shall be operated in compliance with all applicable codes, ordinances <br />and regulations of federal, state and local government, and all required licenses and <br />permits shall be obtained and remain in effect during the operation of the facility. <br /> <br />(h) All taxes/fees associated with the property and/or the use shall be paid when <br />due. <br /> <br />REVOCATION OF PERMIT: <br />4. Violation of any of the above conditions may <br /> <br />serve as grounds for revocation of the use permit by City Council.” <br /> <br />Ayes: Cherry, Edmonds, Meeks, Moody, Psimas, Whitaker, Wright <br />Nays: None <br /> <br />16 - 39 - Use permit: <br /> <br />16-39 (b): <br /> <br /> Motion by Ms. Psimas, and seconded by Mr. Moody, to adopt the following <br />resolution approved on first reading at the February 9, 2016 meeting, and was adopted <br />by the following vote: <br /> <br />“RESOLUTION GRANTING A USE PERMIT (UP-16-01) FOR THE CONSTRUCTION <br />OF MULTI-FAMILY HOUSING AT 1 LEXINGTON DRIVE. <br /> <br /> <br />WHEREAS, <br /> Portsmouth Redevelopment and Housing Authority, the owner of the <br />subject property, by and through its agent Scott Chewning, has made application <br />pursuant to Section 40.1-2.3B of the Code of the City of Portsmouth, Virginia (2006) for <br />the granting of a use permit for the construction of multi-family housing at 1 Lexington <br />Drive; and <br /> <br />WHEREAS <br /> , the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br />WHEREAS <br /> , the Planning Commission has recommended the granting of the <br />application for a use permit with conditions. <br /> <br />NOW, THEREFORE, BE IT RESOLVED <br /> by the Council of the City of <br />Portsmouth, Virginia: <br /> <br /> 1. That it finds that the use for which the permit is sought: <br /> <br />(a) Complies with the applicable standards of the Zoning Ordinance; <br /> <br />(b) Is consistent with the comprehensive plan; <br /> <br />(c) Is compatible with the character of surrounding lands and the uses permitted in <br />the zoning district(s) of surrounding lands; <br /> <br /> <br /> <br />
