February 23, 2016 <br /> <br />(c) Is compatible with the character of surrounding lands and the uses permitted in <br />the zoning district(s) of surrounding lands; <br /> <br />(d) Is configured to minimize adverse effects, including the visual impacts of the <br />proposed use on adjacent lands; <br /> <br />(e) Avoids significant deterioration of water and air resources, and other natural <br />resources; <br /> <br />(f) Maintains safe and adequate egress and ingress onto the site, and safe road <br />conditions around the site; <br /> <br />(g) Allows for the protection of property values and the ability of neighboring lands to <br />develop the uses permitted in the zoning districts; and <br /> <br />(h) Complies with all other city, state, and federal laws and regulations. <br /> <br /> 2. 7-Eleven, Inc. and SEJ Asset Management & Investment Company are <br />hereby granted a use permit pursuant to Section 40.1-2.3(B) of the Code of the City of <br />Portsmouth, Virginia (2006) for the expansion of an existing fuel operations facility at <br />1200 High Street, Portsmouth, Virginia, said property being more particularly described <br />as: <br /> <br />UP-16-02 <br /> <br />1200 High Street <br />(Tax Parcel 0038-1300) <br /> <br />A PARCEL OR TRACT OF LAND, being, lying and situate in the City of Portsmouth, <br />Virginia, at the northwest corner of the intersection of High Street and Elm Avenue, also <br />designated as Parcel A on a plat entitled “AMENDED SUBDIVISION OF THE <br />SOUTHLAND CORPORATION PROPERTY”, recorded in Map Book 12, page 54, in the <br />Clerk’s Office of the Circuit Court of the City of Portsmouth, Virginia, and being more <br />particularly described as follows: <br /> <br />BEGINNING at an iron pin found at the intersection of the westerly right of way line of <br />Elm Avenue and the northerly right of way line of High Street; thence, along the <br />northerly right of way line of High Street, N 87°12’15” W, 127.29 feet to an iron pin set <br />and common corner with the lands, now or formerly, of The Southland Corporation; <br />thence along the easterly and common line of The Southland Corporation, S 2°47’45” E, <br />160.00 feet to an iron pin set; thence, along the southerly and common line of The <br />Southland Corporation, S 87°12’15” E, 128.29 feet to an iron pin set in the westerly right <br />of way line of Elm Avenue; thence, along the westerly right of way line of Elm Avenue S <br />3°09’10” W, 160.00 feet to the point of beginning, containing an area of 20,447 square <br />feet or 0.46840 acres. <br /> <br />BEING that certain property conveyed to SEJ Asset Management & Investment <br />Company by Deed from 7-Eleven, Inc. dated October 1, 2013 and recorded in the <br />Clerk’s Office of the Circuit Court for the City of Portsmouth, Virginia as Instrument <br />Number 130011761. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) The site development shall generally conform to the conceptual site plans <br />entitled 7-Eleven Existing Store NO. 24488, 1200 High Street, Portsmouth, VA 23704 <br />prepared by Core States Group dated March 2, 2015, 7-Eleven #24488, 1200 High <br />Street, Portsmouth, VA prepared by Jimco Sales and Manufacturing, #24488, 1200 <br />High Street, Portsmouth, Virginia prepared by Cummings, and High Street 7-Eleven <br />Concept Plan, 1200 High Street, Portsmouth, VA prepared by Blakeway Corporation. <br /> <br />(b) The development shall meet the requirements set forth in Portsmouth City Code <br />Section 40.1-4.3(C)(9)(c)(i-vii) – Conditions for Gasoline Sales. <br /> <br /> <br /> <br />
