February 23, 2016 <br /> <br />At a Regular Meeting of the City Council on Tuesday, February 23, 2016, there <br />were present: <br /> <br />Mayor Kenneth I. Wright, Vice Mayor Elizabeth M. Psimas, William E. Moody, Jr., Paige <br />D. Cherry, Dr. Curtis E. Edmonds, Sr., Danny W. Meeks, Dr. Mark M. Whitaker, City <br />Manager Dr. L. Pettis Patton, City Attorney Solomon H. Ashby, Jr. <br /> <br />Reverend R. Kirk Culpepper opened the meeting with prayer, which was followed <br />by the Pledge of Allegiance to the Flag. <br /> <br /> Mayor Wright called the meeting to order and welcomed all in attendance. <br /> <br /> Motion by Ms. Psimas, and seconded by Dr. Edmonds, to approve the minutes of <br />a Called Meeting of February 9, 2016, of a Regular Meeting of February 9, 2016, and of <br />a Called Meeting of February 16, 2016, and was adopted by the following vote: <br /> <br />Ayes: Cherry, Edmonds, Meeks, Moody, Psimas, Whitaker, Wright <br />Nays: None <br /> <br />16 - 58 - Presentation: <br /> <br /> <br /> <br /> Presentation of lapel pins to newly appointed board and commission members. <br /> <br />- Unfinished Business - <br /> <br />Consent Agenda: <br /> <br />16 - 39 - Rezoning and use permits: <br /> <br /> Motion by Mr. Moody, and seconded by Ms. Psimas, to adopt the following <br />ordinance and resolution approved on first reading at the February 9, 2016 meeting, <br />and was adopted by the following vote: <br /> <br />16-39 (a): <br /> <br />“ZONING AMENDMENT ORDINANCE Z-15-08.” <br /> <br />16-39 (c): <br /> <br />“RESOLUTION GRANTING A USE PERMIT (UP-16-02) FOR THE EXPANSION OF <br />AN EXISTING FUEL OPERATIONS FACILITY AT 1200 HIGH STREET. <br /> <br /> <br />WHEREAS, <br /> 7-Eleven, Inc. and SEJ Asset Management & Investment Company, <br />the owner of the subject property, by and through their agent Stephen R. Romine, <br />Esquire, have made application pursuant to Section 40.1-2.3B of the Code of the City of <br />Portsmouth, Virginia (2006) for the granting of a use permit for the expansion of an <br />existing fuel operations facility at 1200 High Street; and <br /> <br />WHEREAS <br /> , the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br />WHEREAS <br /> , the Planning Commission has recommended the granting of the <br />application for a use permit with conditions. <br /> <br />NOW, THEREFORE, BE IT RESOLVED <br /> by the Council of the City of <br />Portsmouth, Virginia: <br /> <br /> 1. That it finds that the use for which the permit is sought: <br /> <br />(a) Complies with the applicable standards of the Zoning Ordinance; <br /> <br />(b) Is consistent with the comprehensive plan; <br /> <br /> <br /> <br /> <br /> <br />
