192 February 24, 1987 to a larger portion of the former Truxtun Elementary School facilit~ NOW, THEREFORE, BE IT RESOLVED by the Ccuncil of the City of Portsmouth, Virginia: 1. That the use for which the use permit is sought: (a) Will not adversely affect the health and safety of persons residing ~r~ working in the neighborhood of the proposed ~se~ (b) Will not be detrimental to the public use or injurio~ to the property or improvements in the neighborhood; and ~c) Will be in accordance with the purposes of the Zoning Chapter of the City Code. 2. The Virginia District Convocation of the United Holy of America, Inc. is hereby granted to use permit pursuant to ~40-75 (b) of the City Code to operate a childcare center at the former Truxtun Elementary School which is lecated on the north side of Elliott Avenue between Deep Creek and Frederick Boulevards and described as Tax Plate 151, Parcel 3 (UP-87-3). 3. This use permit is approved subject to the following conditions: ia) A standard site improvement plan must be submitted to the Department of Engineering and technical Services for review and approval. The site olan must show a minimum of 16,400 square feet of fenced play area. (b) The fenced play area should five (5) foot wooden privacy fence and all shall be conducted within the fenced play of 8:00 a.m. and 6:00 p.m. be enclosed by a minimum outdoor Flay activities area and between the hour (c] All interior operations of the facility must be con- ducted between the hours of 6:00 a.m. and 6:00 p.m. (d) The childcare center may be operated with an enroll- merit of not more than eighty-two (82) children to be cared for at the facility at any cne time. (el All health, fire and bulding codes must be met prior to commencement of operation of this facility. (f) The applicant'shall comply with all applicable codes ordinance, policies and regulations of federal, state and local governments, and shall obtain all necessary licenses and permits. 4. That the resolution granting a use permit to the Virginia District Convocation of United Holy Church of America, Inc. to operate a childcare center at the former Truxtun Elementary School adopted by this Ccuncil on June 24, 1986 shall be, and hereby is, recinded."
