192 <br /> <br />February 24, 1987 <br /> <br />to a larger portion of the former Truxtun Elementary School facilit~ <br /> NOW, THEREFORE, BE IT RESOLVED by the Ccuncil of the City of <br />Portsmouth, Virginia: <br /> <br /> 1. That the use for which the use permit is sought: <br /> <br /> (a) Will not adversely affect the health and safety of <br />persons residing ~r~ working in the neighborhood of the proposed <br />~se~ <br /> <br /> (b) Will not be detrimental to the public use or injurio~ <br />to the property or improvements in the neighborhood; and <br /> <br /> ~c) Will be in accordance with the purposes of the Zoning <br />Chapter of the City Code. <br /> <br /> 2. The Virginia District Convocation of the United Holy <br />of America, Inc. is hereby granted to use permit pursuant to ~40-75 <br />(b) of the City Code to operate a childcare center at the former <br />Truxtun Elementary School which is lecated on the north side of <br />Elliott Avenue between Deep Creek and Frederick Boulevards and <br />described as Tax Plate 151, Parcel 3 (UP-87-3). <br /> <br /> 3. This use permit is approved subject to the following <br />conditions: <br /> <br /> ia) A standard site improvement plan must be submitted to <br />the Department of Engineering and technical Services for review and <br />approval. The site olan must show a minimum of 16,400 square feet <br />of fenced play area. <br /> <br /> (b) The fenced play area should <br />five (5) foot wooden privacy fence and all <br />shall be conducted within the fenced play <br />of 8:00 a.m. and 6:00 p.m. <br /> <br />be enclosed by a minimum <br />outdoor Flay activities <br />area and between the hour <br /> <br /> (c] All interior operations of the facility must be con- <br />ducted between the hours of 6:00 a.m. and 6:00 p.m. <br /> <br /> (d) The childcare center may be operated with an enroll- <br />merit of not more than eighty-two (82) children to be cared for at <br />the facility at any cne time. <br /> <br /> (el All health, fire and bulding codes must be met prior <br />to commencement of operation of this facility. <br /> <br /> (f) The applicant'shall comply with all applicable codes <br />ordinance, policies and regulations of federal, state and local <br />governments, and shall obtain all necessary licenses and permits. <br /> <br /> 4. That the resolution granting a use permit to the Virginia <br />District Convocation of United Holy Church of America, Inc. to <br />operate a childcare center at the former Truxtun Elementary School <br />adopted by this Ccuncil on June 24, 1986 shall be, and hereby is, <br />recinded." <br /> <br />Ayes: Corprew, Gray, Lucas, Simpson, Webb, Holley <br />Nays: None <br /> <br />86-338 Group Housing Project <br /> <br /> (d) Resolution grantmng approval of a group housing pro- <br />iect pursuant to Section 50-55 of the Code, for 34 two-bedroom and <br /> 3 one-bedroom condominium units at the southeast corner of Enter- <br />prise Way and Goode Way, deferred from the regular meeting of <br />November 25, 1986, was taken up and read.
