June 9, 2015 <br /> <br />(c) UP-15-05 PARADISE CREEK INDUSTRIAL CORRIDOR - Stephen E. <br />Heretick, on behalf of PER Properties, is requesting a Use Permit <br />to operate a concrete processing facility, including the use of <br />portable stone crushing equipment, at 3991 Elm Avenue. PER <br />Properties is also requesting to deviate from the access and <br />screening requirements for heavy industrial facilities in the IN, <br />Heavy Industrial district. The property is designated for Heavy <br />Industrial uses on the City’s Comprehensive Plan’s Generalized <br />Future Land Use Map. Edward Barham, 4101 Duke Drive, spoke in support of this item. <br /> <br />Motion by Ms. Psimas, and seconded by Mr. Meeks, to concur with the <br />recommendation of the Planning Commission that UP-15-05 be approved on first <br />reading, and was denied by the following vote: <br /> <br />Ayes: Meeks, Moody, Psimas <br />Nays: Cherry, Edmonds, Whitaker, Wright <br /> <br />- Unfinished Business - <br /> <br />15 - 196 - Code amendment: <br /> <br />15-196 (a): <br /> <br /> Motion by Ms. Psimas, and seconded by Dr. Whitaker, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />“ORDINANCE REPEALING CHAPTER 14 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (2006) AND ADOPTING A NEW CHAPTER 14.1 <br />PERTAINING TO FLOOD PROTECTION.” <br /> <br />Ayes: Cherry, Edmonds, Meeks, Moody, Psimas, Whitaker, Wright <br />Nays: None <br /> <br />- City Manager’s Report - <br /> <br />15 - 224 - Adoption of an ordinance (a) accepting a grant in the amount of <br />$118,930 from the Land and Water Conservation Fund and appropriating said <br />funds in the FY 2014-15 Grants Fund, (b) appropriating $118,930 to be received <br />from the Elizabeth River Project in the FY 2014-15 Grants Fund, and (c) <br />authorizing the execution of agreements for the receipt of the grant funds and the <br />Elizabeth River Project funds and the use of said funds to perform improvements <br />to Paradise Creek Nature Park. Vision Principles: Bold New Directions, <br />Neighborhoods and a Sense of Community, and Lifelong Learning Community. <br /> <br />Background: <br /> <br /> ERP owns and is beginning the final phase of capital improvements to Paradise <br />Creek Nature Park. In accordance with its Agreement with the City of Portsmouth as <br />amended August 23, 2011, ERP will transfer ownership of the Park to the City after <br />completion of the final phase of improvements in 2015.
