November 25, 2014 <br />(d) S-14-03 VICTORY CROSSING/NEW PORT - Ordinance granting the <br />request of Thomas C. Kleine, with Troutman Sanders LLP, to close <br />a right-of-way containing 0.13 acres located north of McLean Street <br />and west of Interstate 264 that was retained when the interior <br />streets in Fairwood Homes were closed on May 10, 2005. The <br />purpose in closing this right-of-way is to allow for the development <br />of a Wal-Mart Grocery Store. Vision Principle: A Robust Economy <br />for Working Men and Women. <br />Motion by Ms. Psimas, and seconded by Mr. Edmonds, to defer Items 14-441(b), <br />14-441(c), and 14-441(d) by request of the applicant to the December 9, 2014 City <br />Council meeting, and was adopted by the following vote: <br />Ayes: Cherry, Edmonds, Meeks, Moody, Psimas, Randall, Wright <br />Nays: None <br />- Unfinished Business - <br />14 - 407 -Code amendment: <br />CA-14-01 CITYWIDE - Proposed amendments to City of Portsmouth Zoning <br />Ordinance address a number of minor technical changes, to include, but <br />are not limited to; allowing heavy industrial uses with a use permit where <br />certain heavy industrial uses were prohibited; creating a staff committee to <br />make recommendations on proposed building and site designs to the <br />zoning administrator; creating alternative options for new commercial <br />developments to provide windows on corner lots; allowing micro-breweries <br />as now required by the Code of Virginia; creating a temporary use permit <br />for outdoor gatherings; prohibiting the storage of construction equipment on <br />residential lots; and to allow by-right massage therapy, tattoo parlors, and <br />family day care homes with certain requirements. Roger Cornett, 201 Thelmar Lane, spoke in opposition to the proposed prohibition <br />of the storage of construction equipment on residential lots. <br />2. Glenna Cornett, 201 Thelmar Lane, spoke in opposition to the proposed prohibition <br />of the storage of construction equipment on residential lots. <br />3. Mark Geduldig-Yatrofsky, P. O. Box 50141, voiced his concern with several <br />proposed code amendment changes. <br />Motion by Ms. Psimas, and seconded by Mr. Edmonds, to delete the proposed <br />bed and breakfast restriction, Item #17, and the proposed allowance to receive <br />development application on properties with delinquent taxes, Item #11, and adopted by <br />the following vote: <br />Ayes: Cherry, Edmonds, Meeks, Moody, Psimas, Randall, Wright <br />Nays: None <br />Motion by Ms. Psimas, and seconded by Ms. Randall, to approve the amended <br />proposal for Family Day Care Homes, Item #10, to allow administrative approval with <br />notification to neighbors and a use permit if there is objection raised, and was adopted <br />by the following vote: <br />Ayes: Cherry, Edmonds, Moody, Psimas, Randall, Wright <br />Nays: Meeks <br />Motion by Ms. Psimas, and seconded by Mr. Edmonds, to approve the revised <br />amendment package which includes the previous motions, and was adopted by the <br />following vote: <br />Ayes: Cherry, Edmonds, Moody, Psimas, Randall, Wright <br />Nays: Meeks <br />
