April 14, 1987 <br /> <br />Rev. Jim Hundley, 1023 Naval Avenue , representing Park View <br />~vic League, asked how the Corps of Engineers report and this stu <br />will zmpact on the feasibility study of Scott's Creek basin, and <br />whether or not the Corps of Engineers' study can be expanded enou <br />to include so.me of the concerns raised by the Waterfront Committee. <br /> <br />the City Manager responded. <br /> <br /> On motion of Mr. Gray and seconded by Mrs. Webb, the following <br />ordinance was approved on first reading, and was adopted by unanimm <br /> <br />"AN ORDINANCE TO APPROPRIATE $43,900 FROM THE CAPITAL <br />IMPROVEMENT FUND FOR THE CITY'S SHARE OF THE ARMY CORPS <br />OF ENGINEERS SCOTT'S CREEK FEASIBILITY STUDY." <br /> <br /> 87-138 Letter from the City Manager recommending adoption of <br />m ordinance to delete Section 118.62 of Chapter 6 of the City Code <br />pertaining to sign bonds. <br /> <br /> "A recent amendment to the Statewide Building Code deleted the <br />requirement for a construction bond for the erection of signs. <br />Chapter 6, Section 118.62 of the City Code requires a $5,000 con- <br />struction and maintenance bond for signs. <br /> <br /> It is the opinion of the City Building Official and the City <br />Attorney, and I concur, that the referenced section of the City <br />Code no longer serves a useful purpose for the following reasons: <br /> <br />In today's economy, $5,000 is an ins~gnifican~ amount <br />compared to the cost of modern-day signs. <br /> <br />The Sign Ordinance (Section 40-284 (1) and Section 40-285 (8)) <br />provides for the removal of abandoned signs and the proper <br />maintenance of existing signs. <br /> <br />No other Hampton Roads city requires a sign bond. <br /> <br />Any sign erected on <br />encroachment permit <br />bond. <br /> <br />City right-of-way would require an <br />and such permit would require a liability <br /> <br />The State Code no longer requires a bond. <br /> <br />It creates time~consuming recordkeeping for staff and <br />unnecessary expense and aggravation for the sign owners. <br /> <br /> Based on the comment provided by the Building Official and <br />City Attorney, I recommend that you adopt the attached ordinance <br />which would delete Section 118.62 of Chapter 6 which pertains to <br />sign bonds." <br /> <br /> On motion of Mrs. Webb and seconded by Mr. Simpson, the follow <br />ing ordinance was adopted on first and final reading, and by the <br />following vote: <br /> <br />"AN ORDINANCE TO AMEND SECTION 6-8 OF THE CODE OF THE <br />CITY OF PORTSMOUTH, VIRGINIA, 1973, BY REPEALING SECTION <br />118.62 THEREOF PERTAINING TO BOND FOR SIGN OWNERS." <br /> <br />Ayes: Barnes, Corprew, Gray, Lucas, Simpson, Webb, Holle <br />Nays: None <br /> <br /> 87-136 Letter from the City Manager recommending adoption <br />of~a resolution to appoint viewers for closing~a portion of Fifth <br />Street between Harrison Street and Henry Street. <br /> <br /> <br />
