242 April 14, 1987 {'In connection with the PortCentre commercial and office devel opment, Portsmouth Redevelopment and Housing Authority has submitte an application to close a portion of Fifth Street between Harrison Street and Henry Street. This application and request for appoint- of viewers has been advertised as required by law. I recommend adopzion of the resolution appointing viewers." On motion of Mrs. Lucas and seconded by Mr. Gray, the followin resolution was adopted, and by the following vote: "A RESOLUTION APPOINTING VIEWERS FOR CLOSING OF A PORTION OF FIFTH STREET BETWEEN HARRISON STREET AND HENRY STREET." WHEREAS, Portsmouth Redevelooment and Housing Authority has made application to vacate, close and siscontinue the hereinafter described portion of Fifth Street, and it appearing that Notice of Applicafion and Request for Appointment of Viewers has been duly advertised as required by law. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that Richard D. Ottavio, Waldo Davis, William Choate, James H. Griffin and James L. Linehan be appointed viewers that George N. Powers, Sr,, anR Matthew L. Peanort be appointed ~lternate viewers in the event one of the preceding viewers fails tc )articipate, said viewers to view the hereinafter described portions >f such streets and to report to this Council in writing whether in their opinion any, and if any what, inconvenience would result in vacating and closing the following: Fifth Street Ail that certain piece or parcel of land, lying and being in the City of Portsmouth, Virginia, being more particularly described as that portion of Fifth Street bounded on the north by the southern side of Harrison Street and bounded on the south by the north- ern side of Henry Street. It is not the intent however to clcse any portion of Randolph Street within its intersection of Fifth Street." Ayes: Barnes, Corprew, Gray, Lucas, Simspon, Webb, Hollo~ Nays: None 87-13- - Letter from the City Manager recommending adoption of an ordinance to amend Section 21-24 of the City Code to comply with the State Code pertaining to the suspension of ~rivers licenses for dB?iggunder the influence. "In an effect to comply with State Code, the attached a~ has been prepared by the City Arrorney pertaining to suspension of drivers licenses while driving under the influence. I concur with the City Attorney and recommend that the attachec ordinance be adopted." On motion of Mrs. Webb and seconded by ~{r. Simpson, the follow- ing ordinance was adopted on first and final reading, and by the following vote: "AN ORDINANCE TO AMEND CHAPTER 21 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, AS A~4ENDED, BY ~MENDING SECTION 21-24 THEREOF PERTAINING TO DRIVERS LICENSES."
