242 <br /> <br />April 14, 1987 <br /> <br /> {'In connection with the PortCentre commercial and office devel <br />opment, Portsmouth Redevelopment and Housing Authority has submitte <br />an application to close a portion of Fifth Street between Harrison <br />Street and Henry Street. This application and request for appoint- <br /> of viewers has been advertised as required by law. <br /> <br />I recommend adopzion of the resolution appointing viewers." <br /> <br /> On motion of Mrs. Lucas and seconded by Mr. Gray, the followin <br />resolution was adopted, and by the following vote: <br /> <br />"A RESOLUTION APPOINTING VIEWERS FOR CLOSING OF A PORTION <br />OF FIFTH STREET BETWEEN HARRISON STREET AND HENRY STREET." <br /> <br /> WHEREAS, Portsmouth Redevelooment and Housing Authority has <br />made application to vacate, close and siscontinue the hereinafter <br />described portion of Fifth Street, and it appearing that Notice of <br />Applicafion and Request for Appointment of Viewers has been duly <br />advertised as required by law. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia, that Richard D. Ottavio, Waldo Davis, William <br />Choate, James H. Griffin and James L. Linehan be appointed viewers <br /> that George N. Powers, Sr,, anR Matthew L. Peanort be appointed <br />~lternate viewers in the event one of the preceding viewers fails tc <br />)articipate, said viewers to view the hereinafter described portions <br />>f such streets and to report to this Council in writing whether in <br />their opinion any, and if any what, inconvenience would result in <br />vacating and closing the following: <br /> <br />Fifth Street <br /> <br /> Ail that certain piece or parcel of land, lying <br />and being in the City of Portsmouth, Virginia, being <br />more particularly described as that portion of Fifth <br />Street bounded on the north by the southern side of <br />Harrison Street and bounded on the south by the north- <br />ern side of Henry Street. It is not the intent however <br />to clcse any portion of Randolph Street within its <br />intersection of Fifth Street." <br /> <br />Ayes: Barnes, Corprew, Gray, Lucas, Simspon, Webb, Hollo~ <br />Nays: None <br /> <br /> 87-13- - Letter from the City Manager recommending adoption of <br />an ordinance to amend Section 21-24 of the City Code to comply with <br />the State Code pertaining to the suspension of ~rivers licenses for <br />dB?iggunder the influence. <br /> <br /> "In an effect to comply with State Code, the attached a~ <br />has been prepared by the City Arrorney pertaining to suspension of <br />drivers licenses while driving under the influence. <br /> <br /> I concur with the City Attorney and recommend that the attachec <br />ordinance be adopted." <br /> <br /> On motion of Mrs. Webb and seconded by ~{r. Simpson, the follow- <br />ing ordinance was adopted on first and final reading, and by the <br />following vote: <br /> <br />"AN ORDINANCE TO AMEND CHAPTER 21 OF THE CODE OF THE CITY <br />OF PORTSMOUTH, VIRGINIA, 1973, AS A~4ENDED, BY ~MENDING <br />SECTION 21-24 THEREOF PERTAINING TO DRIVERS LICENSES." <br /> <br />Ayes: Barnes, Corprew, Gray, Lucas, Simpson, Webb, Hollo~ <br />Nays: Ncne <br /> <br /> <br />
