April 14, 198- <br /> <br /> 1. That the use for which the use permit is sought: <br /> (a) Will not affect the health and safety of persons <br /> g or working in the neighborhood of the proposed use; <br /> (b) Will not be detrimental to the public use or injurious <br />~o the Froperty or improvements in the neighborhood; and <br /> (c) Will be in accord with the purposes of the Zoning <br />chapter of The City Code. <br /> 2. Allicance Life Care Corporation is hereby granted a use <br /> ~ermit pursuant to ~40-75 (b) of the Code of the City of PortSmouth <br />~nia to operate a one hundred eighty (180) bed nursing home, <br />facility to be located on Froperty lying on the west side of Cavalic <br /> [ebard south of Greenwood Drive (Tax Map 548, a portion of Parcel <br />, such parcel consisting of 5.45 acres and the facility construct~ <br />thereon to encompass, but not be limited, to a beauty shop, activit' <br />rcoms and television rooms to fulfill the personal and recreat <br />needs of the residents of the proposed structure. <br /> 3. Th~s use permit is approved subject to the following <br /> conditions: <br /> (a) The facility shall be limited to a maximum of one <br /> hundred eight)- (180) residents at any one time. <br /> <br /> Cb) The applicant shall comply with all applicable Codes, <br /> ordinances, policies and regulations of Federal, State and local <br /> governments. <br /> <br /> (c) A minimum of forty-five (45) parking spaces must be <br />provided on site." <br /> <br /> Ayes: Barnes, Corpr~w, Gray, Simpson,~Webb, H~lley <br /> Nays: None <br /> .Abstaining: Lucas <br /> <br />87-82 - Group housing applications: <br /> <br /> (b) Resolution granting approval of a group housing project <br />pursuant to Section 40-55 of the Code, for 12 garden-type apartment <br />buildings containing 196 units on Froperty located on'the east of <br />Twin Pines Road, north of the Seabcard Coast Line Railroad, approve <br />on first reading at the meeting of March 24, 1987, was taken up and <br />read~ <br /> <br /> On motion of Mr. Gray and seconded by Mrs. Webb, the following <br />resolution was adopted on final reading, and was adopted by the <br />following vote: <br /> <br /> "A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT <br /> PURSUANT TO SECTION 40-55 OF THE CODE OF tHE CITY OF PORTS- <br /> MOUTH, VIRGINIA, 1973, SAID PROJECT CONSISTING OF ONE HUNDRED <br /> NINETY SIX (196) RENTAL APARTMENT UNITS ON 15.08 ACRES OF <br /> LAND ON THE EAST SIDE OF TWIN PINES ROAD. <br /> <br /> WHEREAS, Associated Churchland Investors, by Ronald RiFley of <br />3 R~W, Inc., has made application pursuant to ~40-55 of the Code of <br />the City of Portsmouth, Virginia, 1973, as amended for the granting <br />and approval o£ a group housing project consisting of one hundred <br />ninety s~x (196) rental apartment units on a 15.08 acre parcel on <br />the east side of Twin Pines Road and further described as Tax Map 8, <br />Parcel 3 and Tax Map 900, Parcel 1 such group housing project havin <br />been designated as GHP-87-3; and <br /> <br /> <br />
