June 24, 2014 <br />1. Mark Geduldig-Yatrofsky, P. O. Box 50141, spoke in support of this item. <br />Motion by Mr. Moody, and seconded by Ms. Psimas, to adopt the following <br />ordinance, and was adopted by the following vote: <br />"ORDINANCE TO AMEND SECTIONS 10-112 AND 10-117 OF CHAPTER 10 OF <br />THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (2006) PERTAINING TO <br />THE VOTING PLACES FOR PRECINCT NO. 29 AND PRECINCT NO. 34." <br />Ayes: Cherry, Edmonds, Moody, Psimas, Randall, Wright <br />Nays: None <br />14 - 247 -Adoption of an ordinance authorizing the refunding of $34,529.36 to Cox <br />Virginia Telecom, LLC, d/b/a Cox Communications, LLC, for public service <br />corporation billing erroneously paid during calendar years 2012 and 2013. Vision <br />Principles: Efficient, Responsive Government. <br />Background: <br />• The State Corporation Commission filed for the years 2012 and 2013 on behalf <br />of Cox Virginia Telecom, LLC (Cox). The State reported their value incorrectly, <br />resulting in a partial refund for each year owed to Cox. <br />Discussion: <br />• In a letter dated May 29, 2014 addressed to the Department of Finance and City <br />Treasurer's Office outlines the request for reimbursement of the overpayment related to <br />public service corporation billing. <br />• Pursuant to Virginia Code §58.1-2035, the Commissioner of Revenue reviewed <br />the case and calculated that the amount of $34,529.36 is due to Cox. <br />Financial Impact: <br />• The public service corporation billing refund due to taxpayer is $34,529.36 <br />Recommended Action: <br />• Adoption of the ordinance. Vision Principles: Efficient, Responsive Government. <br />Next Steps Following Council Action: <br />• The City Treasurer's Office will take the necessary steps to issue the refund. <br />Motion by Ms. Psimas, and seconded by Mr. Edmonds, to adopt the following <br />ordinance, and was adopted by the following vote: <br />"ORDINANCE TO REFUND THE SUM OF $34,529.36 TO COX VIRGINIA TELECOM, <br />LLC d/b/a COX COMMUNICATIONS, LLC, FOR ERRONEOUSLY PAID PUBLIC <br />SERVICE CORPORATION BUSINESS PERSONAL PROPERTY TAXES." <br />Ayes: Cherry, Edmonds, Moody, Psimas, Randall, Wright <br />Nays: None <br />14 - 248 -Adoption of an ordinance to realign classification funding level for the <br />Portsmouth Public Schools' FY 2013-14 Operating Budget and to transfer the <br />appropriation of $378,935 in unspent School Activity Funds from the Other <br />Funds -School Activity Fund portion of the FY 2013-14 Education Fund to the <br />Schools' FY 2013-14 General Fund. Vision Principles: Quality of Life and <br />Lifelong Learning Community. <br />Background: <br />• As part of the Fiscal Year 2013 - 2014, City Council adopted an ordinance to <br />appropriate funding by category to the Portsmouth Public School System. <br />• This ordinance required that if the Portsmouth School Board need to move funds <br />across categories, then the board must request approval from City Council before doing <br />so. <br />
