June 10, 2014 <br />Background: <br />• HRSD has requested that the City of Portsmouth grant two easements on City- <br />owned property. <br />• HRSD requires the easements to (1) upgrade existing sewer facilities and (2) adjust <br />the location of facilities in light of the MLK Extension project in Portsmouth and a future <br />Holland Road project in Suffolk. <br />• Easement A: <br />- Located in Portsmouth at the intersection of Elm Avenue and South Street. <br />- Has a width of approximately 30 feet and runs west from Elm Avenue along <br />South Street for approximately 300 feet. HRSD is also seeking a temporary easement <br />for construction within the permanent easement area. <br />• Easement B: <br />- Located in Suffolk on property adjacent to Holland Road. <br />- Has a variable width of 30-40 feet and runs along Holland Road for <br />approximately 416 feet. HRSD is also seeking a temporary easement for construction <br />within the permanent easement area. <br />Discussion: <br />• Easement A: <br />- The proposed easement is located next to a park area operated by the <br />Department of Parks, Recreation and Leisure Services. <br />- HRSD has agreed to relocate and/or replace any sidewalk disrupted by <br />construction and to ensure that pedestrian access along South Street is not disrupted. <br />HRSD's construction plans are subject to approval and oversight by the Department of <br />Engineering. <br />- The Department of Parks, Recreation and Leisure Services has reviewed the <br />proposed easement and has no objection. <br />• Easement B: <br />- The proposed easement is located on property controlled by the Department of <br />Public Utilities as part of the City's reservoir/water facilities in Suffolk. <br />- The proposed easement will not impact current or planned operations on the <br />property. <br />- Public Utilities has reviewed the proposed easement and has no objection. <br />- The HRSD easement will partially overlap an existing sewer easement in favor of <br />the City of Suffolk. The City of Suffolk supports HRSD's request and will sign a consent <br />authorizing Portsmouth to grant the HRSD easement over Suffolk's easement area. <br />• Neither easement will materially diminish the value of the City-owned property it <br />encumbers. The City generally does not charge HRSD for easements which do not <br />materially impact property values. <br />Financial Impact: <br />• None. <br />Recommended Action: <br />• Adopt two (2) Resolutions authorizing the City Manager to execute two (2) Deeds <br />of Easement in favor of HRSD. Vision Principles: Efficient, Responsive Government and <br />Change and New Directions <br />Motion by Mr. Meeks, and seconded by Mr. Moody, to adopt the following <br />resolution, and was adopted by the following vote: <br />14-220 (A): <br />"RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE AN EASEMENT <br />TO HAMPTON ROADS SANITATION DISTRICT ON PROPERTY OWNED BY THE <br />CITY OF PORTSMOUTH ON HOLLAND ROAD IN THE CITY OF SUFFOLK, <br />VIRGINIA FOR THE PURPOSE OF INSTALLING, RELOCATING, UPGRADING, <br />AND/OR MAINTAINING SANITARY SEWER FACILITIES. <br />WHEREAS, Hampton Roads Sanitation District has requested an easement on <br />certain property owned by the City of Portsmouth and located on Holland Road in <br />Suffolk, Virginia, the said property being identified in the records of the Suffolk City <br />Assessor as Tax Parcel 33C(3)7*8; and <br />
