May 13, 2014 <br />Discussion: <br />• Under the new VSMP ordinance, localities will administer the State General <br />Construction Permit which involves acceptance of the registration statement, plan <br />review and approval, inspections and enforcement. Local staff will be responsible for <br />ensuring that developers maintain their stormwater pollution prevention plan. <br />• The new VSMP ordinance includes new stormwater design criteria and water <br />quality criteria for site plans, definitions for exempt activities, requirements for <br />monitoring post construction stormwater management facilities and an administrative <br />hearing and appeals process. <br />Financial Impact: <br />• The initial cost for the VSMP program will be included in the stormwater utility <br />(staffing) and developer fees for site plans and erosion and sediment control. There are <br />no proposed increases in the stormwater utility rate or developer fees at this time. <br />• Developers will have to pay State fees associated with the State permit <br />coverage. Development costs will increase with the new regulations. <br />Recommended Action: <br />• Adoption of the ordinance. Vision Principle: Efficient, Responsive Government. <br />Next Steps Following Council Action: <br />• Forward ordinance to the Virginia Department of Environmental Quality. <br />Motion by Mr. Meeks, and seconded by Mr. Edmonds, to adopt the following <br />ordinance, and was adopted by the following vote: <br />"ORDINANCE REPEALING CHAPTER 31.1 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (2006) AND ADOPTING A NEW CHAPTER 31.2 <br />PERTAINING TO STORMWATER MANAGEMENT." <br />Ayes: Cherry, Edmonds, Meeks, Moody, Randall, Wright <br />Nays: None <br />14 - 183 -Adoption of an ordinance to appropriate in the Other Funds-Grants <br />Fund portion of the FY 2013-14 Education Fund the sum of $60,000 in Individuals <br />with Disabilities Act grant funds received from the Commonwealth of Virginia for <br />delivery of additional instruction to disabled middle and high school students. <br />Vision Principles: Quality of Life and Lifelong Learning Community. <br />Background: <br />• As part of its Fiscal Year 2013 - 2014, the Commonwealth of Virginia provides <br />funds to school divisions to ensure that children with disabilities, including children aged <br />three through five, have access to free appropriate public education that meets their <br />individual needs and prepares them for further education or training, employment and <br />independent living. <br />• The funding is provided through the Individuals with Disabilities Education Act <br />(IDEA). During the fiscal year, Virginia Department of Education (VDOE) provides <br />additional IDEA, Part B 611 SWD Instructional Program Improvement Sub-Grant funds <br />to secondary schools that did not meet the Annual Measurable Objectives (AMOs) for <br />students with disabilities. <br />• VDOE awards an additional $10,000 to each eligible middle and/or high school <br />within a division that did not meet their AMO for students with disabilities in the areas of <br />reading and/or mathematics or graduation indicators. <br />Discussion: <br />• Under the IDEA, Part B 611 SWD Instructional Program Improvement Sub-Grant, <br />the Portsmouth School Board was awarded $60,000 for six middle/high schools that <br />were eligible for funding under this grant. These schools are Churchland Middle, <br />Cradock Middle, William E. Waters Middle, Woodrow Wilson High, Churchland High, <br />and I.C. Norcom High. <br />• The Portsmouth School Board intends to use these grant funds to assist these <br />eligible schools in meeting school improvements requirements by purchasing laptop <br />computers, implementing research-based interventions, and monitoring progress. <br />
