April 22, 2014 3. That the use permit is approved subject to the following conditions which shall be observed by the applicant and any successor in interest: (a) The development of the site shall be in substantial conformity with the concept plans titled CUP Site Plan for Wawa Frederick Boulevard and Scott Street prepared by Kimley-Horn and Associates, Inc. and dated November 15, 2013 and the Architectural Elevations prepared by Cuhaci & Peterson revised January 24, 2014, except as may be necessary to comply with any modifications required by City Ordinances and the City Code during site plan review and approval. (b) Traffic improvements shall include those recommended in the Conclusions and Recommendations identified in the Traffic Impact Analysis for Wawa prepared by Kimley-Horn and Associates Inc., dated February 2014. This shall not include any items included as Additional Improvements for City Consideration. (c) Landscaping improvements on the site shall be consistent in design and materials with those in the approved plans for the Frederick Boulevard Streetscape Demonstration Project. (d) The site development and operation of the establishment shall be in compliance with the City's Noise Ordinance provisions as set out in Section 24-255, Unlawful Excessive Sound, of the City Code. 4. REVOCATION OF PERMIT: Violation of any of the above conditions may serve as grounds for revocation of the use permit by City Council." Vision Principles: Quality of Life and Lifelong Learning Community. Background: • As part of its Fiscal Year 2013 -2014, the Commonwealth of Virginia has established several grant opportunities which includes the Project Graduation Academic Year Academy Grant. • The Project Graduation Grant is a remediation grant to assist students who need to earn verified credits to complete their diploma requirements. • Grant proposals are accepted from individual school divisions and from partnerships of school divisions within a Superintendent's Regional Study Group. Discussion: • The Virginia Department of Education awarded $290,679 from the Project Graduation Grant to the Portsmouth Region II Public Schools. • As part of a regional study group, the Portsmouth Public Schools will receive $19, 536. • The Project Graduation Grant does not require a local match. • The Portsmouth School Board has passed a resolution on 6 February 2014 requesting the City Council to appropriate this amount for use in its Grant Fund for Fiscal Year 2013 - 2014. Financial Impact: • The appropriation of $19,536 will increase the funding in the Fiscal Year 2013 - 2014 Portsmouth Public Schools Grant Fund. Recommended Action: • Adoption of the ordinance.
