April 22, 2014 <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br />(a) The development of the site shall be in substantial conformity with the concept <br />plans titled CUP Site Plan for Wawa Frederick Boulevard and Scott Street prepared by <br />Kimley-Horn and Associates, Inc. and dated November 15, 2013 and the Architectural <br />Elevations prepared by Cuhaci & Peterson revised January 24, 2014, except as may be <br />necessary to comply with any modifications required by City Ordinances and the City <br />Code during site plan review and approval. <br />(b) Traffic improvements shall include those recommended in the Conclusions and <br />Recommendations identified in the Traffic Impact Analysis for Wawa prepared by <br />Kimley-Horn and Associates Inc., dated February 2014. This shall not include any <br />items included as Additional Improvements for City Consideration. <br />(c) Landscaping improvements on the site shall be consistent in design and <br />materials with those in the approved plans for the Frederick Boulevard Streetscape <br />Demonstration Project. <br />(d) The site development and operation of the establishment shall be in compliance <br />with the City's Noise Ordinance provisions as set out in Section 24-255, Unlawful <br />Excessive Sound, of the City Code. <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by City Council." <br />Ayes: Cherry, Edmonds, Meeks, Moody, Psimas, Randall, Wright <br />Nays: None <br />- City Manager's Report - <br />14 - 160 -Adoption of an ordinance to appropriate in the Portsmouth Public <br />Schools' FY 2013-14 Grants Fund-Schools Operating Fund the sum of $19,536 in <br />Project Graduation Grant funds received from the Commonwealth of Virginia. <br />Vision Principles: Quality of Life and Lifelong Learning Community. <br />Background: <br />• As part of its Fiscal Year 2013 -2014, the Commonwealth of Virginia has <br />established several grant opportunities which includes the Project Graduation Academic <br />Year Academy Grant. <br />• The Project Graduation Grant is a remediation grant to assist students who need <br />to earn verified credits to complete their diploma requirements. <br />• Grant proposals are accepted from individual school divisions and from <br />partnerships of school divisions within a Superintendent's Regional Study Group. <br />Discussion: <br />• The Virginia Department of Education awarded $290,679 from the Project <br />Graduation Grant to the Portsmouth Region II Public Schools. <br />• As part of a regional study group, the Portsmouth Public Schools will receive <br />$19, 536. <br />• The Project Graduation Grant does not require a local match. <br />• The Portsmouth School Board has passed a resolution on 6 February 2014 <br />requesting the City Council to appropriate this amount for use in its Grant Fund for <br />Fiscal Year 2013 - 2014. <br />Financial Impact: <br />• The appropriation of $19,536 will increase the funding in the Fiscal Year 2013 - <br />2014 Portsmouth Public Schools Grant Fund. <br />Recommended Action: <br />• Adoption of the ordinance.
