April 22, 2014 WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of the application for a use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That it finds that the use for which the permit is sought: (a) Complies with the applicable standards of the Zoning Ordinance; (b) Is consistent with the comprehensive plan; (c) Is compatible with the character of surrounding lands and the uses permitted in the subject property's zoning district; (d) Is configured to minimize adverse effects, including the visual impacts of the proposed use on adjacent lands; (e) Avoids significant deterioration of water and air resources, and other natural resources; (f) Maintains safe and adequate egress and ingress onto the site and safe road conditions around the site; (g) Allows for the protection of property values and the ability of neighboring lands to develop the uses permitted in their zoning district(s); (h) Complies with all other city, state, and federal laws and regulations. 2. That Rebkee Partners Scott, LLC is hereby granted a use permit pursuant to Section 40.1-2.3B of the Code of the City of Portsmouth, Virginia (2006) to construct a convenience store with gas sales at 1098 Frederick Boulevard, Portsmouth, Virginia, and being more particularly described as: U P-14-02 1098 Frederick Boulevard (portion) Beginning at a point, marked P.O.B., being the intersection of the west line of Frederick Boulevard and the north line of Scott Street; thence along the said north line of Scott Street the following two courses: along a curve to the right having a radius of 10.00', a length of 15.75', a chord bearing of S 41°55'31" S and a chord of 14.17' to a point; thence S 87°02'16" W, 225.88' to a point; thence leaving the said north line of Scott Street N 02°57'44" W, 43.24' to a point; thence along a curve to the left having a radius of 525.00', a length of 69.37', a chord bearing of N 06°44'51" W and a chord of 69.32' to a point; thence N 10°31'58" W, 110.29' to a point; thence along a curve to the left having a radius of 300.00', a length of 102.45', a chord bearing of N 20°18'58" W and a chord of 101.95' to a point; thence along a curve to the right having a radius of 51.00', a length of 77.94', a chord bearing of N 13°40'50" E and a chord of 70.57' to a point; thence N 57°27'38" E, 56.70' to a point; thence along a curve to the right having a radius of 13,812.16', a length of 50.78', a chord bearing of N 57°32'31" E and a chord of 50.78' to a point; thence N 57°06'41" E, 12.68' to a point; thence along a curve to the right having a radius of 55.00', a length of 86.63', a chord bearing of S 77°45'51" E and a chord of 77.95' to a point on the west line of Frederick Boulevard; thence along the said west line of Frederick Boulevard the following two courses: S 32°38'24" E, 13.32' to a point; thence along a curve to the right having a radius of 1095.92', a length of 414.01', a chord bearing of S 14°00'36"E and a chord of 411.55' to the point and place of beginning containing 2.260 acres.
