(b) Public hearing to consider the Annual Operating Budget that establishes or increases rates on the Cigarette Tax and includes proposed rate changes to take effect on July 1, 2014. 1. Mark Geduldig-Yatrofsky, P. O. Box 50141, asked that City Council provide another public hearing on the Capital Improvement Program and move the budget adoption to the May 27, 2014 Council meeting to give citizens more time to review new information that was provided. - Unfinished Business - 14 - 142 -Use permit: Motion by Mr. Meeks, and seconded by Mr. Moody, to adopt the following resolution approved on first reading at the April 8, 2014 meeting, and was adopted by the following vote: 14-142: "RESOLUTION GRANTING A USE PERMIT (UP-14-02) TO REBKEE PARTNERS SCOTT, LLC TO CONSTRUCT A CONVENIENCE STORE WITH GAS SALES AT 1098 FREDERICK BOULEVARD. WHEREAS, Rebkee Partners Scott, LLC, contract purchaser of the subject property, has made application pursuant to Section 40.1-2.3B of the Code of the City of Portsmouth, Virginia (2006) for the granting of a use permit to construct a convenience store with gas sales at 1098 Frederick Boulevard, Portsmouth, Virginia; and WHEREAS, Wal-Mart Real Estate Business Trust, the owner of the property, has consented to the filing of the application; and
