February 11, 2014 <br />• The Portsmouth School Board passed a resolution on 19 December 2013 asking <br />City Council to re-appropriate the sum to its Textbook Fund for Fiscal Year 2013 - <br />2014. <br />Financial Impact: <br />• The appropriation of $844,019 will increase expenditures in the Fiscal Year 2013 <br />-2014 Education Fund (Other Funds -Textbook Fund). The source of the appropriation <br />is cumulative unspent State funds remaining in the Textbook Fund at June 30, 2013.. <br />Recommended Action: <br />• Adoption of the ordinance. Vision Principles: Quality of Life and Lifelong <br />Learning Community. <br />Next Steps Following Council Action: <br />• Finance will complete the necessary budget adjustments. <br />1. Box 50141, spoke in support of this item but voiced <br />his concern with State funds being appropriated to the Schools by City Council. <br />Motion by Ms. Psimas, and seconded by Mr. Edmonds, to adopt the following <br />ordinance, and was adopted by the following vote: <br />"ORDINANCE APPROPRIATING THE SUM OF $844,019 IN UNSPENT FY 2012-13 <br />STATE TEXTBOOK FUNDS IN THE OTHER FUNDS: TEXTBOOK FUND <br />CLASSIFICATION OF THE FY 2013-14 EDUCATION FUND." <br />Ayes: Cherry, Edmonds, Moody, Psimas, Randall, Wright <br />Nays: None <br />14 - 54 -Adoption of a resolution authorizing the City Manager to execute an <br />easement with Cox Communications Hampton Roads, L.L.C., across a portion of <br />the former Desks, Inc., site along Columbia Street. Vision Principle: A Robust <br />Economy for Working Men and Women. <br />Background: <br />• The City owns property at 800 Crawford Street across from City Hall commonly <br />known as the Desks Inc. site that is subject to a cooperation agreement between the <br />City and EDA for multi-family development by the Breeden Company. <br />• The 2.475-acre property includes a parcel formerly owned by VDOT which was <br />purchased subsequent to the realignment of Crawford Parkway. This was done to <br />square up the site and make it more developable. <br />• A Cox fiber optic cable bisects the former VDOT parcel (the "Jug Handle"). Cox <br />is prepared to move the cable into the Right of Way along Crawford and Bart Streets at <br />its cost, but is requesting an easement along Columbia Street to accommodate tying the <br />cable into an existing drop box. That easement is shown on the attached drawing. <br />Discussion: <br />• The current alignment of the Cox cable lies outside any easement or right of way <br />and, because it cuts diagonally across the property, lies underneath the proposed multi- <br />family building. It must be moved to allow any significant development of the site. <br />• The easement agreement and exhibit have been reviewed and approved for your <br />consideration by City staff and the developer. <br />Financial Impact: <br />• There is no financial impact to the City. <br />Recommended Action: <br />• Adopt the attached resolution.
