July 9, 2013 Background: • There is an existing city drainage easement located on property now owned by T. O. Williams, Inc. having a street address of 300 Wythe Street, Portsmouth, Virginia. • This drainage easement measures 10 ft. X 12.5 ft. and was dedicated to the City of Portsmouth by the Portsmouth Redevelopment & Housing Authority as shown on plat for the Southside II Project - CD - 77, dated September 26, 1977 and duly recorded in the public land records in Map Book 10 at page 31. • T.O. Williams, Inc. is desirous of expanding an existing building that would encroach into the existing drainage easement. Discussion: • The Department of Engineering has determined that this drainage easement is no longer needed and all storm water appurtenances associated with this drainage easement have been abandoned. • Adoption of a resolution will allow the City Manager to execute a deed to vacate and release this drainage easement so as to allow T.O. Williams, Inc to further develop the subject property. Financial impact: • No City funds are involved. Recommended Action: • Adoption of the resolution. Vision Principle: Efficient, Responsive Government. Next Steps Following Council Action: • The City Attorney's Office will prepare the necessary deed of release for execution by the City Manager. Motion by Ms. Psimas, and seconded by Mr. Edmonds, to adopt the following resolution, and was adopted by the following vote: "RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A DEED OF VACATION AND RELEASE OF A CITY DRAINAGE EASEMENT ON THE PROPERTY KNOWN AS 300 WYTHE STREET IN PORTCENTRE. WHEREAS, there exists a City drainage easement on property currently owned by T. O. Williams, Inc., having a street address of 300 Wythe Street within PortCentre; and WHEREAS, no further need exists for the City to retain the drainage easement; and WHEREAS, the City has received a request from the property owner asking the City to vacate and release the drainage easement in order to expand an existing building and to otherwise use their property. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the City Manager be, and he hereby is, authorized to execute a deed of vacation and release of the City drainage easement for which the City has no further need on the property having a street address of 300 Wythe Street in PortCentre."
