May 28, 2013 • Tidewater Medical Transport, LLC agrees that in the normal course of their transport business, while within the City of Portsmouth, if they become aware of an emergency situation, they will report it immediately to the City of Portsmouth's dispatch center to be handled by PFRES. • Tidewater Medical Transport, LLC agrees to maintain to a Virginia Department of Health Office of EMS Agency License and required business license as required by the Code of Virginia. Next Steps Following Council Action: • A copy of City Council's resolution will be sent to Virginia Office of EMS and to Med 1 Inter-Facility Care for inclusion in their application for EMS Agency License. Motion by Ms. Psimas, and seconded by Mr. Meeks, to adopt the following resolution, and was adopted by the following vote: "RESOLUTION GRANTING APPROVAL FOR TIDEWATER MEDICAL TRANSPORT, LLC, TO PROVIDE CERTAIN TRANSPORT SERVICES WITHIN THE CITY OF PORTSMOUTH. WHEREAS, Section 15.2-955 of the Code of Virginia provides that no organization shall provide emergency medical services (EMS) without the prior approval by resolution of the local governing body; and WHEREAS, Virginia Administrative Code regulations, specifically 12 VAC 5-31- 420, also require that an EMS agency receive an ordinance or resolution from the governing body of each locality where the agency maintains an office or stations an EMS vehicle for response within a locality; and WHEREAS, Tidewater Medical Transport, LLC, a private emergency medical services agency, desires a resolution supporting a state license to provide certain medical transport services in the City of Portsmouth, Virginia. NOW THEREFORE, BE IT RESOLVED, by the Council of the City of Portsmouth, Virginia, that: 1. Tidewater Medical Transport, LLC, ("Tidewater") is hereby granted approval to provide certain medical transport services within the City of Portsmouth, Virginia and to obtain agency license approval from the Virginia Office of Emergency Medical Services in accordance with the following requirements which shall apply when Tidewater is providing services within the City of Portsmouth: (a) Tidewater shall limit its transport services to nonemergency transports when operating in the City of Portsmouth. (b) Tidewater shall not attempt to provide service to, nor shall it respond to, emergency situations (commonly known as "911 Calls") within the City unless requested by an authorized official of the Portsmouth Department of Fire, Rescue, and Emergency Services or through a written agreement with the City. (c) Tidewater shall immediately report any emergency situation that it encounters in the normal course of its transport business within the City of Portsmouth to the dispatch center to be handled by the Department of Fire, Rescue, and Emergency Services.
