May 28, 2013 <br />NOW THEREFORE, BE IT RESOLVED, by the Council of the City of <br />Portsmouth, Virginia, that: <br />1. American Lifeline Medical Transport, Inc., ("American") is hereby granted <br />approval to provide certain medical transport services within the City of Portsmouth, <br />Virginia and to obtain agency license approval from the Virginia Office of Emergency <br />Medical Services in accordance with the following requirements which shall apply when <br />American is providing services within the City of Portsmouth: <br />(a) American shall limit its transport services to nonemergency transports when <br />operating in the City of Portsmouth. <br />(b) American shall not attempt to provide service to, nor shall it respond to, <br />emergency situations (commonly known as "911 Calls") within the City unless <br />requested by an authorized official of the Portsmouth Department of Fire, Rescue, and <br />Emergency Services or through a written agreement with the City. <br />(c). American shall immediately report any emergency situation that it encounters in <br />the normal course of its transport business within the City of Portsmouth to the dispatch <br />center to be handled by the Department of Fire, Rescue, and Emergency Services. <br />(d) American shall comply with all applicable federal, state and local laws and <br />regulations, maintain a valid Virginia Department of Health Office of Emergency Medical <br />Services license and a valid business license, pay all federal, state and local taxes, and <br />keep its transport vehicles and medical equipment in a safe, neat, well-maintained and <br />sanitary condition. <br />2. The Fire Chief is hereby authorized by City Council to enforce the terms of <br />this resolution. If the Fire Chief determines that there has been a material violation of <br />any provision hereof, or any other conduct that places public safety or the public interest <br />at risk, he shall report it to the Virginia Office of Emergency Medical Services and shall <br />thereafter cooperate with said Office in any investigation. <br />3. This resolution shall take effect on the date of its adoption." <br />Ayes: Cherry, Edmonds, Meeks, Moody, Psimas, Wright <br />Nays: None <br />13 - 226 -Adoption of a resolution granting approval for Tidewater Medical <br />Transport, LLC, to provide certain transport services within the City of <br />Portsmouth. Vision Principle: Bold New Directions. <br />Background: <br />• Virginia Emergency Medical Services Regulations (12VAC5-31) & Virginia Code <br />§ 15.2-955 requires that private medical transport businesses receive an ordinance or <br />resolution from the governing body of each locality where the agency maintains an <br />office, stations an EMS vehicle for response within a locality. This ordinance or <br />resolution must specify the geographic boundaries of the agency's primary service area <br />within the locality. <br />• In April 2012, the CEO for Tidewater Medical Transport, LLC requested approval <br />to operate as anon-emergency transport service provider within the City of Portsmouth. <br />Discussion: <br />• Fire Chief Beck Barfield has reviewed and approved the application for <br />Tidewater Medical Transport, LLC to provide certain non emergency transport services <br />within the City of Portsmouth with the conditions as follows: <br />• Tidewater Medical Transport, LLC agrees to limit its transport business to that of <br />non-emergency transports at all times when operating within the City of Portsmouth. <br />• Tidewater Medical Transport, LLC agrees that it will not attempt to provide nor <br />respond to emergency situations (commonly known as "911" calls) within the City, <br />unless requested by the Portsmouth Fire Rescue and Emergency Services Department <br />(PFRES) through a mutual aid agreement. <br />
