May 28, 2013 Background: • Virginia Emergency Medical Services Regulations (12VAC5-31) & Virginia Code § 15.2-955 requires that private medical transport businesses receive an ordinance or resolution from the governing body of each locality where the agency maintains an office, stations an EMS vehicle for response within a locality. This ordinance or resolution must specify the geographic boundaries of the agency's primary service area within the locality. • In April 2012, the President for American Lifeline Medical Transport Inc. requested approval to operate as anon-emergency transport service provider within the City of Portsmouth. Discussion: • Fire Chief Beck Barfield has reviewed and approved the application for American Lifeline Medical Transport Inc. to provide certain non emergency transport services within the City of Portsmouth with the conditions as follows: • American Lifeline Medical Transport Inc. agrees to limit its transport business to that of non-emergency transports at all times when operating within the City of Portsmouth. • The American Lifeline Medical Transport Inc. agrees that it will not attempt to provide nor respond to emergency situations (commonly known as "911" calls) within the City, unless requested by the Portsmouth Fire Rescue and Emergency Services Department (PFRES) through a mutual aid agreement. • American Lifeline Medical Transport Inc. agrees that in the normal course of their transport business, while within the City of Portsmouth, if they become aware of an emergency situation, they will report it immediately to the City of Portsmouth's dispatch center to be handled by PFRES. • American Lifeline Medical Transport Inc. agrees to maintain to a Virginia Department of Health Office of EMS Agency License and required business license as required by the Code of Virginia. Financial Impact: • There is no financial impact to the City of Portsmouth. Staff Recommends: • Adoption of a resolution. Vision Principle: Neighborhoods and a Sense of Community. Next Steps Following Council Action: • A copy of City Council's resolution will be sent to Virginia Office of EMS and to Med 1 Inter-Facility Care for inclusion in their application for EMS Agency License. Motion by Mr. Moody, and seconded by Mr. Meeks, to adopt the following resolution, and was adopted by the following vote: "RESOLUTION GRANTING APPROVAL FOR AMERICAN LIFELINE MEDICAL TRANSPORT, INC., TO PROVIDE CERTAIN TRANSPORT SERVICES WITHIN THE CITY OF PORTSMOUTH. WHEREAS, Section 15.2-955 of the Code of Virginia provides that no organization shall provide emergency medical services (EMS) without the prior approval by resolution of the local governing body; and WHEREAS, Virginia Administrative Code regulations, specifically 12 VAC 5-31- 420, also require that an EMS agency receive an ordinance or resolution from the governing body of each locality where the agency maintains an office or stations an EMS vehicle for response within a locality; and WHEREAS, American Lifeline Medical Transport, Inc., a private emergency medical services agency, desires a resolution supporting a state license to provide certain medical transport services in the City of Portsmouth, Virginia.
