February 26, 2013 <br />(f) Maintains safe and adequate egress and ingress onto the site and safe road <br />conditions around the site; <br />(g) Allows for the protection of property values and the ability of neighboring lands <br />to develop the uses permitted in their zoning district(s); <br />(h) Complies with all other city, state, and federal laws and regulations. <br />2. That the applicant is hereby granted a use permit pursuant to Section 40.1- <br />2.3(6) of the Code of the City of Portsmouth, Virginia (2006) to operate a pharmacy <br />with drive-through facilities at 5815, 5821, and 5829 High Street, 3125 Tyre Neck <br />Road, and 5830 Trucker Street, Portsmouth, Virginia, and being more particularly <br />described as: <br />U P-11-05 <br />5815, 5821, and 5829 High Street, <br />3125 Tyre Neck Road, <br />5830 Trucker Street <br />Beginning at a point, being the intersection of the south line of High Street West and <br />the east line of Tyre Neck Road; thence along the said south line of High Street West S <br />85°45'06" E, 567.13' to a point; thence leaving the said south line of High Street West <br />S 06°30'15" W, 299.99' to a point; thence N 85°45'02" W, 25.02 to a point on the north <br />line of Trucker Street; thence along the said north line of Trucker Street N 85°45'02" W, <br />542.26' to a point on the east line of Tyre Neck Road; thence leaving the said north line <br />of Trucker Street along the said east line of Tyre Neck Road N 06°31'58" E, 300.00' to <br />the point and place of beginning, containing 3.903 acres. <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br />(a) The lane widths for Eastbound High Street shall be: <br />Inside lane: 11ft. <br />Outside lane: 12 ft. <br />Right turn lane: 12.6 to 13.1 ft. <br />(b) Northbound right turn movement driveway (onto High St.) shall be striped with <br />six-foot continental style crosswalk. <br />(c) Southbound full movement driveway (onto Trucker St.) should be striped with <br />six-foot. continental style crosswalk. <br />(d) Westbound full movement driveway (onto Tyre Neck Rd.) shall be striped with <br />six-foot continental style crosswalk. <br />(e) The site shall be developed in substantial compliance with the site plan <br />submitted by Kimley-Horn dated November 14, 2012. <br />(f) The building shall be developed in conformance with the submitted elevations <br />dated November 15, 2012 <br />(g) The recommendations of the Traffic Impact Analysis created November <br />2012 must be installed at the developer's expense. <br />(h) All uses on the property shall be operated in compliance with all applicable <br />codes, ordinances, and regulations of federal, state, and local governments. <br />(i) The applicant shall obtain and keep current all required licenses and permits <br />before operation and these licenses and permits shall remain in effect during the <br />operation of the establishment. <br />(j) Taxes and fees associated with the property shall be paid when due. <br />4.
