<br />At a Regular Meeting of the City Council on Tuesday, February 26, 2013, there
<br />were present:
<br />Mayor Kenneth I. Wright, Vice Mayor Paige D. Cherry, William E. Moody, Jr., Marlene
<br />W. Randall, Elizabeth M. Psimas, Dr. Curtis E. Edmonds, Sr., Danny W. Meeks, City
<br />Manager John L. Rowe, Jr., City Attorney George M. Willson.
<br />Councilman Curtis E. Edmonds, Sr., opened the meeting with prayer, which was
<br />followed by the Pledge of Allegiance to the Flag.
<br />Mayor Wright called the meeting to order and welcomed all in attendance.
<br />Motion by Ms. Psimas, and seconded by Ms. Randall, to approve the minutes of
<br />a Called Meeting of February 11, 2013, of a Called Meeting of February 12, 2013, of a
<br />Regular Meeting of February 12, 2013, of a Called Meeting of February 19, 2013, and of
<br />a Closed Meeting of February 21, 2013, and was adopted by the following vote:
<br />Ayes: Cherry, Edmonds, Meeks, Moody, Psimas, Randall, Wright
<br />Nays: None

<br />13 - 61 -Use permits:
<br />13-61 (A):
<br />Motion by Mr. Moody, and seconded by Mr. Edmonds, to adopt the following
<br />resolution approved on first reading at the February 12, 2013 meeting, and was adopted
<br />by the following vote:
<br />"RESOLUTION GRANTING A USE PERMIT (UP-13-01) TO OPERATE A
<br />PHARMACY WITH DRIVE-THROUGH FACILITIES AT 5815, 5821, AND 5829 HIGH
<br />STREET, 3125 TYRE NECK ROAD, AND 5830 TRUCKER STREET.
<br />WHEREAS, G. Eric Doering, P.E., agent for Rebkee Company, has made
<br />application pursuant to Section 40.1-2.3(B) of the Code of the City of Portsmouth,
<br />Virginia (2006) for the granting of a use permit to operate a pharmacy with drive-
<br />through facilities at 5815, 5821, and 5829 High Street, 3125 Tyre Neck Road, and
<br />5830 Trucker Street, Portsmouth, Virginia; and
<br />WHEREAS, the applicant and the Planning Director have done all things
<br />required to be done in connection with said application; and
<br />WHEREAS, the Planning Commission has recommended the granting of the
<br />application for a use permit with conditions.
<br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
<br />Portsmouth, Virginia:
<br />1. That it finds that the use for which the permit is sought:
<br />(a) Complies with the applicable standards of the Zoning Ordinance;
<br />(b) Is consistent with the comprehensive plan;
<br />(c) Is compatible with the character of surrounding lands and the uses permitted in
<br />the subject property's zoning district;
<br />(d) Is configured to minimize adverse effects, including the visual impacts of the
<br />proposed use on adjacent lands;
<br />(e) Avoids significant deterioration of water and air resources, and other natural
<br />resources;
