<br />Motion by Mr. Heretick, and seconded by Mr. Edmonds, to adopt the following
<br />resolution, and was accepted by the following vote:
<br />"RESOLUTION ACCEPTING THE FY-2011-12 AUDIT AS BEING TIMELY
<br />PREPARED AND FILED.
<br />BE IT RESOLVED by the Council of the City of Portsmouth, Virginia:
<br />1. That the City's 2011-12 independent audit, as duly prepared by Cherry,
<br />Bekaert & Holland, is hereby accepted as timely filed, pursuant to Section 15.2-2511 of
<br />the Code of Virginia.
<br />2. That City Council reserves the right of inquiry concerning matters
<br />disclosed in the audit.
<br />3. That this resolution shall take effect on the date of its adoption."

<br />Motion by Mr. Whitehurst, and seconded by Ms. Randall, to amend the agenda to
<br />add an item providing for a separation agreement for the City Attorney, and was
<br />adopted by the following vote:
<br />Ayes: Edmonds, Heretick, Moody, Randall, Whitehurst, Wright
<br />Nays: None
<br />Motion by Mr. Whitehurst, and seconded by Mr. Edmonds, to accept the
<br />resignation of the City Attorney, effective December 31 of this year, and that the Mayor
<br />be authorized and directed to sign a Separation Agreement substantially the same as
<br />that which is attached to this motion, and was adopted by the following vote:

<br />12 - 496 -Report on Pending Items
<br />• Dana Woodson, Public Information Officer, gave an update on items of concern
<br />presented by citizens at the November 27, 2012 City Council Meeting.
<br />12 - 497 -Non-Agenda Speakers
<br />1. Linda Ridenour, 313 Tarreyton Lane, informed City Council and citizens of the new
<br />programming on Portsmouth School Education Television (PSET). She also spoke
<br />on the Star Base Victory Program.
<br />2. Lee Cherry, 1108 Melvin Drive, informed City Council and citizens of Santa Claus
<br />coming to the Railroad Museum.
<br />3. Sheriff Watson, 701 Crawford Street, welcomed the new City Manager John Rowe.
<br />4. Clyde Toler, 1029 Blair Street, voiced his concern with various issues in the City.
<br />5. Steve Carroll, 3112 Riveredge Drive, voiced his opposition to the relocation of the
<br />City Jail.
<br />6. Barbara Williams, 1400 County Street, voiced her concern with her waste
<br />management bill. She also asked for help in assisting her sister with housing and
<br />with the crosswalks at the bus stops.
