November 27, 2012 <br />(a) The applicant shall be responsible for the cost of establishing and/or upgrading <br />the necessary utilities. <br />(b) The applicant shall adhere to the approved trash handling plan which includes <br />private trash pickup. <br />(c) All taxes and fees associated with the proposed project shall be paid when due. <br />3. EXPIRATION OF PERMIT: Unless extended as provided under Section <br />40.1-2.3 of the Code of the City of Portsmouth, Virginia (2006), the housing use permit <br />shall expire for any portion of the approved project for which building permits have not <br />been issued if the applicant fails to apply for all building permits for the entire project <br />within two years of the adoption of this resolution. <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the permit by the City Council." <br />Ayes: Cherry, Edmonds, Heretick, Moody, Randall, Wright <br />Nays: Whitehurst <br />Motion by Mr. Edmonds, and seconded by Mr. Hererick, to adopt the following <br />resolution approved on first reading at the November 13, 2012 meeting, and was <br />adopted by the following vote: <br />12-439(8): <br />"RESOLUTION REPEALING AND AMENDING CERTAIN CONDITIONS OF GROUP <br />HOUSING USE PERMIT (GHP-06-02A) AT 723 AND 725 HIGH STREET AND 714 <br />KING STREET. <br />WHEREAS, Virginia Housing Development Authority, pursuant to Section 40.1- <br />2.3 of the Code of the City of Portsmouth, Virginia (2006), as amended, has made <br />application for repeal and/or amendment of the conditions of Group Housing Use Permit <br />(GHP-06-02A) at 723 and 725 High Street and 714 King Street, Portsmouth, Virginia; <br />and <br />WHEREAS, the City Council originally approved Housing Use Permit (GHP-06- <br />02) by Resolution R-06-18 on April 11, 2006; and <br />WHEREAS, the subject property is furthermore described as: <br />GHP-06-02A <br />723 High Street <br />All that certain lot piece or parcel of land with its appurtenances situate in the City of <br />Portsmouth Virginia and being bounded and described as follows to wit: Beginning at a <br />point on the south side of High Street 180 feet west of the southwest intersection of <br />High Street and Green Street and from thence running west along the south side of <br />High Street eight 8 feet more or less to the brick building of S Lasting thence south <br />along the line of said brick building 113 feet thence east eight feet more or less and <br />thence north 113 feet to the point of beginning. <br />725 High Street <br />That certain lot piece or parcel of land with the buildings and improvements thereon and <br />the appurtenances thereunto belonging situate on the south side of High Street between <br />Effingham Street and Green Street in the City of Portsmouth Virginia bounded and <br />described as follows: Beginning 135 feet east from the southeast intersection of <br />Effingham Street with High Street thence east along High Street 45 feet thence south <br />113 feet thence west 45 feet and thence north 113 feet to the point of beginning. It <br />being the same property conveyed to M M Crockin Company Inc., a Virginia <br />corporation, by deed from Hyman Lasting and Edna Lasting, his wife; Sol Lasting and <br />Elizabeth Lasting, his wife; Leon Lasting and Kathryn Lasting, his wife; Rose L Kanter, <br />widow; Flossie L Rosen, widow; Isabelle K.
