November 27, 2012 <br />WHEREAS, Virginia Housing Development Authority, pursuant to Section 40.1- <br />2.3 of the Code of the City of Portsmouth, Virginia (2006), as amended, has made <br />application for repeal and/or amendment of the conditions of Housing Use Permit (HP- <br />07-03) at 719 High Street, Portsmouth, Virginia; and <br />WHEREAS, the City Council originally approved Housing Use Permit (HP-07-03) <br />by Resolution R-07-19 on April 24, 2007; and <br />WHEREAS, the subject property is furthermore described as: <br />H P-07-03A <br />719 High Street <br />Beginning at a point 125 west of the southwest corner of High and Green Streets thence <br />in a westerly direction 45 to a point thence in a southerly direction 229 to a point thence <br />in an easterly direction 45 to a point thence in a northerly direction 229 to a point of the <br />beginning. <br />and <br />WHEREAS, the Planning Commission has reviewed the submitted application <br />and site plan and has recommended conditional approval of said application; and <br />WHEREAS, the applicant has been informed that approval of the housing permit <br />does not constitute a waiver of any other requirement embodied in the City Zoning <br />Ordinance or any other applicable local, state or federal law or regulation; and <br />WHEREAS, the applicant is aware that building permits and any other required <br />permit will be issued only upon compliance with the ordinances, laws or regulations <br />applicable thereto. <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br />1. That, coupled with the terms imposed by paragraph 2 hereof, the following <br />conditions exist: <br />(a) The proposed complies with the applicable standards of the City Zoning <br />Ordinance; <br />(b) The proposed use is consistent with the comprehensive plan; <br />(c) The proposed use is compatible with the character of surrounding lands and the <br />uses permitted in the zoning district(s) of surrounding lands; <br />(d) The proposed use is configured to minimize adverse effects, including the visual <br />impacts of the proposed use on adjacent lands; <br />(e) The proposed use avoids significant deterioration of water and air resources, and <br />other natural resources; <br />(f) The proposed use maintains safe and adequate egress and ingress onto the site, <br />and safe road conditions around the site; <br />(g) The proposed use allows for the protection of property values and the ability of <br />neighboring lands to develop the uses permitted in the zoning districts; and <br />(h) The use complies with all other city, state, and federal laws and regulations. <br />2. That all conditions originally imposed on the subject property are repealed. <br />The applicant and any successor in interest shall be subject to the following conditions: <br />
