November 27, 2012 <br />dated January 2, 1975 and recorded January 2, 1975 in the Clerk s Office of the Circuit <br />Court of the City of Portsmouth Virginia in Deed Book 658 at page 127. <br />714 King Street <br />That certain lot of land with the buildings thereon and the appurtenances thereto <br />belonging situate in the City of Portsmouth Virginia and bounded as follows: <br />Beginning 102 feet from the northeast intersection of King and Effingham Streets on the <br />north side of King Street; thence running north along the line of the property now or <br />formerly owned by Wm. S. Cooke 113 feet; thence east parallel with King Street 78 feet; <br />thence south parallel with Effingham Street 113 feet to King Street; and thence <br />west along King Street 78 feet to the point of beginning on the line of Wm. S. Cooke. <br />It being the same property conveyed to M. M. Crockin Company, Inc., a Virginia <br />corporation, by deed from S .Lasting and Brother, Incorporated, a Virginia corporation, <br />dated May 30, 1974 and recorded June 7, 1974 which is recorded in the Clerk s Office <br />of the City of Portsmouth Virginia in Deed Book 647 at page 708. <br />and <br />WHEREAS, the Planning Commission has reviewed the submitted application <br />and site plan and has recommended conditional approval of said application; and <br />WHEREAS, the applicant has been informed that approval of the housing permit <br />does not constitute a waiver of any other requirement embodied in the City Zoning <br />Ordinance or any other applicable local, state or federal law or regulation; and <br />WHEREAS, the applicant is aware that building permits and any other required <br />permit will be issued only upon compliance with the ordinances, laws or regulations <br />applicable thereto. <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br />1. That, coupled with the terms imposed by paragraph 2 hereof, the following <br />conditions exist: <br />(a) The proposed complies with the applicable standards of the City Zoning <br />Ordinance; <br />(b) The proposed use is consistent with the comprehensive plan; <br />(c) The proposed use is compatible with the character of surrounding lands and the <br />uses permitted in the zoning district(s) of surrounding lands; <br />(d) The proposed use is configured to minimize adverse effects, including the visual <br />impacts of the proposed use on adjacent lands; <br />(e) The proposed use avoids significant deterioration of water and air resources, and <br />other natural resources; <br />(f) The proposed use maintains safe and adequate egress and ingress onto the site, <br />and safe road conditions around the site; <br />(g) The proposed use allows for the protection of property values and the ability of <br />neighboring lands to develop the uses permitted in the zoning districts; and <br />(h) The use complies with all other city, state, and federal laws and regulations. <br />2. That all conditions originally imposed on the subject property are repealed. <br />The applicant and any successor in interest shall be subject to the following conditions: <br />(a) The applicant shall be responsible for the cost of establishing and/or upgrading <br />the necessary utilities. <br />
