Catlett has made application to vacate, <br />close and discontinue the hereinafter-described portion of Reid <br />Street, and it appearing that Notice of Application and Request <br />for Appointment of Viewers has been duly advertised as required by <br />law. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia, that Richard D. Ottavio, Waldo Davis, <br />William Choate, James H. Griffin and James L. Linehan be appointed <br />viewers and that L. A. Clarke and Howard Davis be appointed alter- <br />nate viewers in the event one of the preceeding fails to participat <br />said viewers to view the hereinafter-described portion of such <br />street amd tp report to th&s Council in writing whether in their <br />opinion any,'and~l~ an~ w~at, inconvenience would result in vacatin <br />and closing the following: <br /> <br /> Ali that certain piece or parcel of land, lying <br />and being ~n the City of Portsmouth, Virginia, being <br />more particularly described as the southerly portion <br />of Reid Street being the remaining portion of Reid <br />Street not being incorporated into the subdivision <br />"Afton Villas" measuring 40 feet in width, 74.27 on <br />the westerly side and 98.35 feet on the easterly side, <br />and being a part of Block 116 "A" Map of Cradock." <br /> <br />Ayes: Barnes, Corprew, Gray, Lucas, Simpson, Webb, <br />Nays: Ncne <br /> <br /> 87-279 Letter from the City Manager recommending adoption of <br />a resolution to appoint ~iewers for closing of a portion of <br />Westmoreland Avenue. <br /> <br /> "Franklin H. Lawson has made application to close a portion of <br />Westmoreland Avenue north of Clifford Street. The Notice of <br />Application and Request for Appointment of Viewers have been duly <br />advertised as required by law. <br /> <br /> While from the planimetric maps the property appears to <br />include navigable water, staff inspection revealed that the area <br />is mostly marshlands. As such, any use would require permit approw <br />from the A~my Corps of Engineers. <br /> <br />I recommend adoption of the resolution appointing viewers." <br /> <br /> Motion of Mrs. Lucas and seconded by Mr. Simpson to suspend, <br />the rules for citizens to speak~ and was adopted by unanimous vote <br /> <br /> John M. Carter, Attorney, 301 Columbia Street, representing <br />applicant, spoke in support of the matter, and answered <br /> <br /> Motion of Mr. Simpson and seconded by Mrs. Webb, the following <br />resolution was adopted, and by the following vote: <br /> <br />"A RESOLUTION APPOINTING VIEWERS FOR CLOSING OF A PORTION <br />OF WESTMORELAND AVENUE. <br /> <br /> WHEREAS, Frank H. Lawson has made application to vacate, close <br />and discontinue the hereinafter-described portion of Westmoreland <br />Avenue, and it appearing that Notice of Application and Request for <br />Appointment of Viewers has been dul~ advertised as required by law. <br /> <br /> NOW, THEREFORE, BE I~ RESOLVED by the Council of the City of <br />Portsmouth, Virginia, that Richard D. Ottavio, Simon P. Arrington, <br />Robert McCurdy, James V. McGehee and Raymond Tweed be appointed <br />viewers and that C. L. Knight and Emmerson Smith be appointed <br />alternate viewers in the event one of the preceeding fails to <br />participate, said viewers to view the hereinafter-described portion <br />of such street and to report to this Council in writing whether in <br />their ¢lq~ig~o~ any, and if any what, inconvenience would result in <br />~y~$~Fg-.and closing the following: <br /> <br /> <br />
