360 <br /> <br />June 23, 198- <br /> <br />"AN ORDINANCE ~0 AMEND THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1973, BY AMENDING CHAPTER 40 THEREOF BY ADDING <br />THERETO SECTION 40-57, PERTAINING TO FEES FOR PARKING <br />VARIANCES, AND BY AMENDING SECTION 40-55 (5), PERTAINING <br />TO FEES FOR GROUP HOUSING EXTENSIONS OR MODIFICATIONS." <br /> <br />Ayes: Barnes, CorFrew, Gray, Lucas, S-impson, Webb, Holle~ <br />Nays: None <br /> <br />87-212 - Use permit application: <br /> <br /> (a) Resolution granting a use permit for single-family town- <br />houses, located at 5903 Campbell Street, approved on first reading <br />at the regular meeting of June 9, 1987, was taken up and read. (UP <br /> <br /> On motion of Mrs. Webb and seconded by Mrs. Lucas, the followi <br />resolution was adopted, and by the following vote: <br /> <br />"A RESOLUTION GRANTING A USE PERMIT TO MWD, INC. FOR THREE <br />TOWNHOUSE UNITS ON TNB SOUTH SIDE OF CAMPBELL STREET WEST <br />OF TYRE NECK ROAD. <br /> <br /> WHEREAS, MWD, INC., by Richard Dale, has made application <br /> ~ursuant ~40-75 (b) for a use permit to construct three (3) town- <br /> units on approximately .29 of an acre Of vacant property on <br />the south side of Campbell Street west of Tyre Neck Road (Tax Map <br />821, Parcel 13); and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all <br />things required to be done in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the granting <br />of a use permit with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That the use for which the use permit is sought: <br /> <br /> (a) Will not adversely affect the health and safety of <br />persons residing or working in the neighborhood of the proposed use <br /> <br /> (b) Will not be detrimental to the public use or injurious <br />to the property or improvements in the neighborhood; and <br /> <br /> (c) Will be in accord with the purposes of the Zoning <br />Chapter of the City Code. <br /> <br /> 2. MWD, Inc. is hereby granted a uSe'oPermitt pursuant to <br />840-75 (b) for three (3) townhouse units ~ be constructed on the <br />south side of Campbell Street west of Tyre Neck Road said property <br />being further described as Tax Map 821, Parcel 13. <br /> <br /> 3. This use Fermit is approved subject to the following <br />conditions: <br /> <br /> (a) Deed restrictions shall be established to assure <br />continuity of maintenance of the exterior of the buildings and <br />grounds and the documents establishing same shall be submitted to <br />the City Attorney for review and approval prior to recordation of <br />same. The applicant shall cause the deed restrictions to be record <br />in the Office of the Clerk of the Circnit Court of the City of <br />Portsmouth prior to the issuance of any occupancy permits." <br /> <br />Ayes: Barnes, Corprew, Gray, Lucas, Simpson, Webb, Holle <br />Nays: None <br /> <br /> <br />
