358 June 23, 198- (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use (b) Will not be detrimental to the public use or iniuriou to the property or improvements in the neighborhood; and (c) Will be in accordance with the purposes of the Zoning Chapter of the City Code. 2. Christian Antioch Church of God is hereby granted a use permit pursuant to $40-75 (b) of the City Code to operate a child daycare center at 2200 P~t~cT-St~e~t 7~Ta~ ~a~' 1:1~, pa~c~ls: .. 23, 34 and 36), the activity to be conducted in the educational portion of the existing Church structure, such parcel being more specifically described as follows: (UP-87-12) BEGINNING at the northeast intersection of Palmer Street and Deep Creek Boulevard; thence northerly along the east right-of-way of Deep Creek Boulevard 75'; thence easterly 100' to the west right-of-way of an alley; thence southerly along said alley to the north right-of-way of Palmer Street; thence west along said right-of-way to Deep Creek Boulevard, the Point of Beginning. Also, beginning on the north right-of-way of Palmer Street 125' west from its intersection with the west right-of-way of Azalea Avenue; thence west along said right-of-way 76.48' to the east right-of-way line of an alley; thence northerly along said alley 134.86'; thence east 188.66' to the west right-of-way of Azalea Avenue; thence south along said right-of-way 75'; thence west 125'; thence south 34.5' to the north right-of-way of Palmer Street, the Point of Beginning. 3. The use permit is approved subje?t to the following conditions: (a) The child daycare center may be operated within an enrollment of not more than thirty-eight (38) children to be cared for at the facility at any one time. (b) The applicant shall install a solid hedge along the northern porperty line and a five (5) foot wooden privacy fence around the designated outdoor play area. (c) The applicant shall install a four (4) foot ~icket fence around approximately two hundred (200) square feet of area adjoining the daycare entrance, this fence to connect with the rea play area which will be totally enclosed by the five (5) foot woode privacy fence noted above. (d) The facility activities shall be conducted between hours of 8:00 a.m. and 6:00 p.m. with~'o~tdoor play activities and within the on-site parking applicable codes limited to the hours of 8:00 a.m. p~ay area. spaces.
