July 24, 2012 <br />Ayes: Cherry, Edmonds, Heretick, Moody, Randall, Whitehurst, Wright <br />Nays: None <br />12 - 302 -Adoption of an ordinance to repeal Sections 22-267, 22-268, and 22- <br />268.1 of the Code of the City of Portsmouth, Virginia (2006) pertaining to the <br />issuance of hauling permits for the transport of seagoing containers, concrete <br />mixer vehicles, and vehicles hauling excavated material. Vision Principles: <br />Change and New Direction and Neighborhoods and a Sense of Community. <br />Background: <br />• House Bill 806 (hauling permit equity legislation) was passed during the last <br />General Assembly session. <br />• Every county, city and town cannot issue multi trip hauling permits for travel over <br />routes under its jurisdiction for seagoing containers, concrete mixer vehicles, and <br />vehicles hauling excavated material. <br />• The City must enter into a memorandum of understanding (MOU) with the <br />Commissioner of the Department of Motor Vehicles no later than January 1, 2013. <br />Discussion: <br />• DMV has created a mechanism to issue statewide multi trip hauling permits from <br />a centralized system for designated permits. <br />• The permits that are issued under these sections of city code are without cost. <br />• The permits issued by DMV will be valid on all unrestricted state and local <br />highways. <br />Financial Impact <br />• For existing permits that were no charge, DMV will effective January 1, 2013 <br />collect $130.00 per permit. Localities will receive $120.00 to address road damage on a <br />lane mile basis. The monies that localities receive will be proportional to the lane miles <br />traveled within their boundaries. <br />Recommended Action: <br />• Adoption of the recommended ordinance. Vision Principles: Change and New <br />Direction and Neighborhoods and a Sense of Community. <br />Next Steps Following Council Action: <br />• Repeal City Code Ordinances 22-267, 22-268 and 22-268.1. <br />Motion by Mr. Whitehurst, and seconded by Ms. Randall, to adopt the following <br />ordinance, and was adopted by the following vote: <br />"ORDINANCE TO REPEAL SECTIONS 22-267, 22-268, AND 22-268.1 OF THE <br />CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (2006) PERTAINING TO THE <br />ISSUANCE OF HAULING PERMITS FOR THE TRANSPORT OF SEAGOING <br />CONTAINERS, CONCRETE MIXER VEHICLES, AND VEHICLES HAULING <br />EXCAVATED MATERIAL." <br />Ayes: Cherry, Edmonds, Heretick, Moody, Randall, Whitehurst, Wright <br />Nays: None <br />12 - 303 -Adoption of a resolution authorizing the City Manager to enter into an <br />agreement with the Virginia Department of Motor Vehicles for the issuance of <br />certain overweight vehicle permits on behalf of the City of Portsmouth. Vision <br />Principles: Change and New Direction and Neighborhoods and a Sense of <br />Community. <br />Background: <br />• House Bill 806 (hauling permit equity legislation) was passed during the last <br />General Assembly session. <br />• Every county, city and town that wishes to issue hauling permits for travel over <br />routes under its jurisdiction must enter into a Memorandum of Understanding (MOU) <br />with the Commissioner of the Department of Motor Vehicles (DMV) no later than <br />January 1, 2013. <br />
