May 22, 2012 <br />Background: <br />• The court settlement involving the new courts facility included a requirement that <br />there be for an access road connecting the court facility with the City Hall area. This <br />roadway would provide access other than that provided by Port Centre Parkway. <br />• Location and preliminary plans were provided to VDOT in December of 2011. <br />• The proposed roadway will connect to Bart St., which is part of the I-264 <br />interchange and defined as a limited access highway. <br />• Approval to make this connection required approval of the Commonwealth <br />Transportation Board (CTB) and the Federal Highway Administration. <br />Discussion: <br />• Construction of the access road and connecting to Bart St. was approved by the <br />CTB at its meeting on April 18, 2012 and subsequently by the Federal Highway <br />Administration. <br />• The City of Portsmouth is required to pay for the subject connection. <br />• The building of the roundabout left an odd shaped parcel of land next to the <br />VDOT ventilation building as shown on the attached plat. It was proposed and <br />accepted by VDOT to transfer this 0.161 acre parcel to VDOT in exchange for <br />permitting a break in the limited access boundary. <br />Financial Impact: <br />• The transfer of the parcel in question will have no financial impact as it does not <br />represent a buildable lot for the City of Portsmouth. <br />Recommended Action: <br />• Adoption of the required ordinance. Vision Principle: Change and New Direction. <br />Next Steps Following Council Action: <br />• Prepare the conveyance documents and complete the property transfer. <br />1. Mark Geduldig-Yatrofsky, P. O. Box 50141, asked that the cost of having an access <br />road be the burden of those using it, specifically the Judiciary. <br />Motion by Mr. Whitehurst, and seconded by Mr. Edmonds, to adopt the following <br />resolution, and was adopted by the following vote: <br />"RESOLUTION AUTHORIZING TRANSFER OF A 0.161 ACRE PARCEL OF LAND <br />ADJACENT TO THE DOWNTOWN TUNNEL VENTILATION BUILDING TO THE <br />VIRGINIA DEPARTMENT OF TRANSPORTATION (VDOT) IN EXCHANGE FOR <br />VDOT'S GRANTING A BREAK IN THE LIMITED ACCESS BOUNDARY OF BART <br />STREET ADJACENT TO THE CRAWFORD STREET ROUNDABOUT TO ALLOW <br />FOR THE CONSTRUCTION OF THE NEW COURT ACCESS ROAD. <br />WHEREAS, in exchange fora 0.161 acre parcel of land adjacent to the <br />Downtown Tunnel, as shown on the attached Exhibit A, attached hereto and made a <br />part hereof, the Virginia Department of Transportation will permit a break in the limited <br />access boundary of Bart Street adjacent to the Crawford Street roundabout to allow for <br />the construction of an access road to the new courts complex. <br />NOW THEREFORE BE IT RESOLVED by the Council of the City of Portsmouth, <br />Virginia that it hereby authorizes the transfer of 0.161 acres of land, as described on <br />Exhibit A hereof, to the Virginia Department of Transportation and authorizes the City <br />Manager to execute such documents as are required to accomplish said purpose." <br />Ayes: Cherry, Edmonds, Heretick, Moody, Randall, Whitehurst, Wright <br />Nays: None <br />
