<br />Mr. Moody offered the following nominations:
<br />Portsmouth Port & Industrial Commission
<br />Carl R. Varner to be appointed to fill a five year term ending December 31, 2017,
<br />replacing Douglas Smith.
<br />Motion by Mr. Moody, and seconded by Mr. Cherry, to close nominations, and
<br />the above nominations were adopted by the following vote:

<br />12 - 223 -Items Submitted by Council Members
<br />• Adoption of an ordinance (1) to appropriate the sum of $4,900,000 in the
<br />FY 2012-13 General Fund and the FY 2012-13 Education Fund for the operation of
<br />the Portsmouth Public Schools, (2) to appropriate the sum of $2,809,460 in the FY
<br />2011-12 General Fund to provide aone-time bonus to city employees, employees
<br />of constitutional officers, and retirees of the Portsmouth Supplemental and the
<br />Portsmouth Fire and Police Retirement Systems, and (3) to transfer and to
<br />appropriate the sum of $682,153 to various FY 2011-12 Operating Budget Funds.

<br />Background:
<br />• On May 10, 2012, the Portsmouth School Board passed a resolution requesting
<br />that City Council re-appropriate $4,900,000 of surplus funds for their FY 2012-13
<br />Operating Budget.
<br />• Per City Council's direction, the City Administration requested that the
<br />Portsmouth City School Board return to the City the total balance of $9,943,787 in
<br />surplus funds remaining at June 30, 2011.
<br />• On May 18, 2012 the Portsmouth City School Board remitted the requested
<br />surplus funds to the city.
<br />• In anticipation of the action above, on May 15, 2012 during the Budget Work
<br />Session, City Council by consensus approved aone-time 3% bonus for eligible City
<br />employees and employees of Constitutional Officers and aone-time 1.5% bonus
<br />payment for retirees of the Portsmouth Supplemental Retirement System and the Fire
<br />and Police Retirement System.
<br />Discussion:
<br />Re-appropriation of School Funds
<br />• The school's FY 2010-11 CAFR shows $9,943,979 available in the School
<br />Construction Fund. These funds have been identified and classified as excess local
<br />funds. In accordance with State Law (Sec. 22.1-100), these funds have been returned
<br />to the city for re-appropriation by the City Council.
<br />• At a meeting on May 10, 2012 the School Board of the City of Portsmouth
<br />adopted a resolution initiating the formal request to the City Council to re-appropriate
<br />$4,900,000 to the Portsmouth Public Schools system for the purpose of providing funds
<br />for its FY 2012-13 operating budget.
<br />• The attached ordinance appropriates $4,900,000 to the FY 2012-13 Education
<br />Fund for the purpose of providing additional funding for the Portsmouth Public Schools
<br />Operating Budget, per the School Board's request.
<br />Bonus Payment
<br />• In order to be eligible for the bonus payment, City employees and employees of
<br />Constitutional Officers must meet the following requirements as of June 1, 2012:
<br />o be non-probationary; and,
<br />o continue to be employed; and,
<br />o be full-time, non-temporary.
