May 22, 2012 <br />3. The following conditions imposed on the child care operation by City <br />Council Resolution R-04-09 on February 24, 2004 shall remain in full force and effect: <br />(a) The occupancy of the child care center shall not exceed 72 children at any one <br />time. <br />(b) Indoor hours of operation shall be limited to the hours between 6:30 a.m. to 6:00 <br />p.m. Monday through Friday. <br />(c) Outdoor play hours shall be limited to the hours between 8:00 a.m. and dusk <br />Monday through Friday. <br />(d) The outdoor play area shall be enclosed with fencing at least four feet in height. <br />(e) A minimum of 14 off-street parking spaces for the child care center shall be <br />provided. <br />(f) No on-street parking for drop-off/pick up of children associated with the child care <br />center shall be permitted. <br />(g) The facility shall be operated in accordance with the plan approved by the <br />Director of General Services to store handle and remove trash garbage on site. <br />(h) The facility shall be open to all required inspections by the City Fire Prevention <br />Bureau Public Health Department and Building Official This shall include an initial <br />inspection prior to the opening of the business and annual inspections thereafter. <br />(i) The facility shall comply with the Statewide Building Code and all other <br />applicable codes ordinances and regulations of federal state and local governments all <br />required licenses and permits shall be obtained and maintained in effect. <br />(j) All taxes and fees owed or collected in connection with the subject property and <br />operations shall be paid when due. <br />(k) The operation of the child care center shall be limited to the first floor of the <br />educational wing of the church." <br />Ayes: Cherry, Edmonds, Heretick, Moody, Randall, Whitehurst, Wright <br />Nays: None <br />- City Manager's Report - <br />12 - 217 -Adoption of an ordinance to de-obligate $2,218,216 of unexpended <br />appropriation authority in closed capital improvement projects, to reprogram <br />$4,748,174 of bond proceeds, and to appropriate $6,966,390 to cover expenses <br />and obligations in various active capital improvement projects. Vision Principles: <br />A Robust Economy for the Working Men and Women, Effective, Responsive <br />Government, and Pride of Past. <br />Background: <br />• The FY2012-2016 Capital Improvement Plan authorized the expenditure of funds <br />for specific projects. These projects were to be funded with General Obligation bonds. <br />At the advice of our financial advisor, existing bond proceeds will be used to finance <br />these expenditures. This negates the incurrence of additional debt to the City at this <br />time. The City Council was briefed by Davenport and Company at the May 10, 2012 <br />Public Work Session. <br />Discussion: <br />• Three completed and closed CIP projects have dollars available for <br />reprogramming; Pinner's Point, McLean Street, and Tidewater Community College. <br />• The Churchland Bridge project is currently in the design phase. Initiation of the <br />construction phase is scheduled in FY15. The bond proceeds assigned to this project <br />can be reprogrammed to fund current project expenditures. <br />• Attachment "A" provides a list of all the projects impacted by these funding <br />adjustments. <br />Financial Impact: <br />• The City benefits financially by using existing bond proceeds and not incurring <br />additional debt. The cost related to the issuance of new debt is also deferred. <br />
